The defense attTney wanted McAnulty to review the news coverage of the case and determine the likelihood that the same level of coverage would continue unless access to pretrial hearings were denied.

Posnansky termed the media's coverage of the case "inflamatory and improper." But Jon Fleischaker, attorney for the newspapers and for WHAS-TV, argued that it would be wrong for the court to review the content of stories already published. "It would be totally inappropriate to condition attendance at future hearings on the quality or quantity of past reporting," Fleischaker said. "That's not for the state to do, that's not for this court to do." Fleischaker asked McAnulty to quash the subpoena, and the judge threw it out. Then WLKY attorney Rebecca Wes-terfield and WAVE attorney Steven H. Keeney whose clients had come to court with their tapes joined in Fleischaker's motion.

McAnulty ruled that it would be "presumptively unconstitutional to close everything," and he required Posnansky to file a new motion "setting forth exactly those proceedings you wish to close." McAnulty said alternatives to barring the press must also be considered. A hearing on the new motion is scheduled for Nov. 28, and Posnansky was required to supply the media attorneys with particulars by Nov. 12. McAnulty delayed action yesterday on a defense motion to bar the press from pretrial proceedings in the case of two men accused of murdering two Trinity High School juniors last month. McAnulty did not overrule the motion, but after hearing arguments he ordered defense attorney Mark A. Pos-nansky to file a more specific motion, detailing which hearings should be closed, and why. The judge also threw out a subpoena that would have required local news executives to submit newspaper clips and tapes of broadcasts concerning the crime and the arrests. The students, Scott Nelson and Richard Stephenson, both 17, were found dead in a vacant lot off Floyd Street early the morning of SepL 30.

Several days later police arrested George Wade, 23, and Victor Taylor, 24, and charged each with murder, robbery, kidnapping and sodomy. Taylor was also charged with being a persistent felon. At a hearing last month, Posnansky, who is defending Wade, filed a motion asking McAnulty to bar the press from all pretrial hearings because he feared the coverage would prejudice his client's right to a fair trial. Frank Jewell, a public defender representing Taylor, joined in the motion. Then on Monday, Posnansky subpoenaed news executives for the Courier-Journal and Louisville Times Co.

The bodies were found near a Maysville bridge Sept. 28 by state police divers, who had been searching for guns believed stolen in Mount Sterling. The women's bodies were found inside a car that authorities said had been missing since February 1983.

Roof fall kills man in Bell County mine Associated Prtst PINEVILLE, Ky. A coal miner was killed and another was seriously injured in roof fall yesterday at a Bell County mine, officials said. The dead man was identified as Terry J. Myrick, 24, of Barbourville, Deputy Bell County Coroner Terrell Gibson said. Carl Collins, 34, also of Barbourville, was listed in serious condition at Pineville Community Hospital.

The accident occurred at 11 a.m. at a mine licensed to Mid-South Coal according to a state Department of Mines and Minerals spokeswoman. The mine is five miles northeast of Pineville. However, Sonny Grubb, a vice president for Mid-South, said the two men were employed by Carolina Coal which was mining the site under contract.
