District Judge Charles Allen Iruled that it doesn't matter what Daniel H. Overmyer did with the money from Peerless Manufacturing because Overmyer owned all the other companies involved in transactions.

Allen told a 14-rnember jury that had listened to days of testimony that Overmyer can't be convicted of stealing "frprn himself. Allen ruled on motions by defense attorney Stanley Arkin of New York -after the government completed its case Thursday. After Allen issued his ruling, Assistant U.S. Attorney Hancy Jones said he will recommend to U.S. At--torney Ronald Meredith that the government appeal the decision and seek a reinstatement of the charge.

The fund transfers, totaling more than $600,000, were largely uncontested. The government hoped to show that when Overmyer bought Peerless in 1977, he put it under the control of another company, John D. which was owned by a trust controlled by Overmyer's daughter. Jones argued that when Overmyer took money from Peerless, he was taking it from the trust and, in essence, from his daughter. However, a bankruptcy court judge in Cleveland had ruled earlier that the trust controlling John D.

Ltd. was essentially a sham, and allowed Overmyer to retain control of the "corporation. What that meant, Arkin told the jury in his opening argument on Tuesday, is that Overmyer was merely moving money "from one pocket to another." Allen agreed. Peerless Manufacturing was founded in Louisville in 1884 and operated at 15th Street and Ormsby Avenue from 1900 until 1980, when it went out of business. The company made commercial and home heaters.

(AP) The Public Service Commission has turned down a request for toll-free telephone service between Caney-ville and Morgantown. 1 The request was made by the Butler County-Morgantown Chamber of Commerce. But the request was not followed up with the required petitions from people in both communities. Those petitions should have been received by the PSC on Oct 6.

In a news release yesterday, the commission said that toll-free service between the communities would have been unlikely anyway because of federal regulations. Caneyvllle, in Grayson County, is located in the Louisville longdistance service area and is served by Continental Telephone Co.
