THE SALINA JOURNAL Money FRIDAY, MAY 29, 1998 A7 T INTEL FTC considers filing lawsuit iiagainst Intel 'By The Associated Press WASHINGTON — Intel Corp. said Thursday it is talking with the Federal Trade Commission about its business practices amid reports that the government plans to accuse the computer chip-maker of abusing its market power. Action against Intel would : follow closely on the heels of the government's dramatic antitrust ;case against Microsoft, the software giant. The FTC investigation coin- 'cides with two private lawsuits against Intel, claiming that the $25 billion company threatened to withhold vital technology from its customers. "Basically, Intel is using its intellectual property as a hammer to make sure that competitors and .customers are kept in line," said Steven Newborn, a Washington lawyer in contact with the FTC about Intel. T ECONOMY Going down Economy's rapid growth is expected to wane By The Associated Press WASHINGTON — The economy sprinted at a 4.8 percent annual rate during the first three months of 1998. But declining corporate profits, a deteriorating trade balance and a record buildup of unsold goods suggest a sharp slowdown ahead. "The first quarter was the mountaintop. We're clearly going downhill from here," said economist Sung Won Sohn of Norwest Corp. in Minneapolis. The seasonally adjusted annual growth rate in the gross domestic product during the first quarter was even faster than the 4.2 percent initially reported last month, the Commerce Department said Thursday. However, the government attributed the upward revision — "The first quarter was the mountaintop. We're clearly going downhill from here." Sung Won Sphn economist and almost a third of total growth during the quarter — to a record backup of unsold goods on shelves and back lots. That suggests American manufacturers may cut production to allow inventories to be sold off, especially if as expected consumers can't keep increasing their spending at the first quarter's red-hot 6.1 percent rate. On the surface, a separate report from the Commerce Department appeared to show economic strength spilling over into the current quarter. Orders to factories for big-ticket durable goods shot up 2.6 percent in April, the biggest gain in five months. But the increase was concentrated in two narrow and volatile categories: military goods, up 52 percent, and civilian aircraft, up 41 percent. Excluding them, orders slipped 0.2 percent. Also, the Labor Department said the number of applications for unemployment benefits declined by 2,000 last week to 312,000. That shows robust demand for labor. But for employers — and the stock market — that's a negative. T MERGER United HealthCare, Humana to merge Increased competition, rising costs spur move to create major HMO By The Associated Press MINNEAPOLIS — Continuing a wave of consolidation in the health care industry, United HealthCare plans to buy Humana in a $5.3 billion stock deal that would create one of the nation's largest managed care companies. The combined company will operate initially under the United HealthCare name and will be based in Minneapolis, while a substantial workforce will remain in Louisville, Ky., where Humana is based. It was the latest corporate union in an industry that has been hit by rising medical costs and intense competition. Last fall, Humana acquired Physician Corp. of America, adding more than 1 million members. The deal would rank United HealthCare third in enrollment behind Blue Cross and Blue Shield and Kaiser Permanente, said Gary Frazier, managing director of Bear Stearns & Co. in New York. It would become the largest publicly traded, for-profit HMO, he said. "It's definitely a reflection of the need to gain market share, to gain leverage in scale in a more competitive managed care industry environment," he said. Jobs will be cut, but Dr. William W. McGuire, United Healthcare's chairman, president and chief executive, said the companies haven't determined how many. United has 30,000 employees, while Humana has 20,000. The merger, which has been approved by the boards of directors of both companies, requires shareholder and regulatory approval and is expected to close in the third quarter of 1998. The Dulles, Va.-based company agreed to provide at least 30 days' notice — via e-mail or through a pop-up screen online — of any changes. "AOL had a history of misleading consumers on changes in costs and services," Michigan Attorney General Frank Kelley said. "This agreement will stop those practices by requiring AOL to inform customers up front." AOL spokeswoman Tricia Primrose said that the agreement ended two years of negotiations with the states and that many, of the terms already were in place'. America Online admitted \rio wrongdoing. The $2.6 million will be shared by the states to cover the costs of the investigation. ; : ' AOL now has paid a total of $34 million to the states. In 1996, AOL settled with 19 states when it switched customers from an hourly use plan to a $19.95-a-month plan.
