The crewmen were released because they expressed "sincere repentance" and because of guarantees given by the U.S. government, said a report from Pyongyang in the Soviet Communist party newspaper. The Soviet press has reported the U.S. apology that led to the release of the crew, Jbut the prior repudiation of the apology has , never been made public here. The crewmen's statements about the brutality of the North Korean captors also has i been ignored in Soviet media. WASHINGTON (AP) — The Supreme Court turned aside Monday a challenge to the mobilization of Army reservists for Vietnam duty without a congressional declaration of war. Justice William O. Douglas, in dissent, said the court had "be' come an agency for helping ,to create an awesome credibility gap." , , He chastised his colleagues and said they "should construe laws as fulfilling, not breaking, promises made by this all-powerful government to its citizens." A group of 113 reservists from the Cleveland area, most of them already in Vietnam, had posed 1 the challenge. They were mobilized under a 1966 law that gave President Johnson authority to call up reservists without a declaration of war or national emergency. The men joined the reserves before the law was passed. Their agreements put a 45-day | top on possible calls to active duty. Yet, when they were called up last spring, it was for up to two years.
