Court overturns conviction, citing prosecutor's 'diatribe' By SY RAMSEY Associated Press FRANKFORT, Ky. The Kentucky Supreme Court yesterday overturned a manslaughter conviction handed down in Pulaski Circuit Court, characterizing a prosecutor's comments the case as "pervasive, vitriolic diatribe." The court ordered a new trial for Gary Vaughn, who was convicted in connection with the July 11, 1980, killing of Robert Steelman, his brother-in-law. He had been given a sentence of 20 years in prison. Testimony at the trial indicated that Vaughn, his sister and the victim had a disagreement about a borrowed water bucket that "escalated into a shoot out involving all three," the justices said. They said that while the prosecutor made improper remarks throughout the trial, his comments during his closing argument prompted the reversal.

Statements by prosecutor Lester Burns "far exceeded commentary based on the evidence, and evinced a desire to characterize the (defendant), his family, his defense and his counsel in contemptuous terms," the Supreme Court said. It said Burns referred to Vaughn as "the pervert, the rifleman, the manhunter, the accused murderer, the Laurel County Rover, the bucket man and the assassin." The court said the defense was characterized as "hogwash, baloney, an untruth, an insult to law and order and the fury's, intelligence, shameful and absolute falsehood." The justices quoted Burns as having said, "I wish to God that Robert Steelman had shot (Vaughn) first and blown his brains out because he should have gotten it." The high court said the prosecutor also ridiculed defense counsel. At one point, the justices said, Vaughn's mother stood up and said, "It's a lie." As she was being removed from the courtroom, Burns commented: "Put her in jail. That is the family. The boy was raised that way.

The Supreme Court said that "an argument so aimed at inciting the jury's passion was clearly prejudicial, and is forcefully condemned by this The was approved by a courecision vote of 6-1, Justice James Stephenson dissenting. Out-of-court settlements reached in nightclub case Associated Press COVINGTON, Ky. More than half the remaining defendants in the final case involving the May 1977 fire at the Beverly Hills Supper Club have reached out-of-court settlements before the scheduled March 2 trial. Campbell Circuit Judge John Diskin has dismissed four other companies as defendants: Guilford Mills and its Lockette Corp. division, Firestone Tire and Rubber and House of Foam Inc.

Diskin said, "There wasn't enough evidence to show that their products were in these chairs in question" when the Southgate club burned, killing 165 people. But those companies will still be part of the trial because one defendant, Gasser Chair Co. of Youngstown, Ohio, has made them "thirdparty" defendants if it is found to have any liability. Besides Gasser, which supplied more than 2,500 chairs to the club, other furniture and foam rubber companies will be defendants in the final trial. Attorneys for the plaintiffs contend that fumes from the burning materials contributed to the deaths.

General Tire Rubber Co. of Akron, Ohio, and Champion International are among the companies that have reached agreement, according to court records. In earlier product liability trials, the aluminum wire industry was cleared, and manufacturers of polyvinyl cloride insulation settled out of court. Nine primary defendants and three or four third-party defendants remain in the final group and could be tried in parts: the first trial to determine cause of the fire; two, the second, if necessary, to apportion blame among all defendants. As snow melts, searchers press for clues to girl's disappearance Associated Press EVANSVILLE, Ind.

Now that rain and warmer temperatures have melted the snow, officials hope that they will be able to find some clues to the disappearance of 12-year-old Michele Lee Pace. Teams of up to 50 police officers and volunteers have been searching an, ever-widening area of Vanderburgh County for the girl since she disappeared on Feb. 2. Evansville Police Sgt. James Lane said two donated helicopters will be used in the search once the last of the snow is gone.
