Pastor Law For Today ... INSANITY IS NOT GROUND FOR DIVORCE IN ILLINOIS Q. If a man's wife has been in a mental institution for more than 40 years, is he legally free to marry another woman? My boy friend says the law won't permit him to get a divorce. A. No married pen-son is free to remarry until the current marriage is legally ended — ether by divorce, annulment or dentil. Insanity (if it is incurable or of long duration is a ground for divorce in most states, but not in Illinois. And 1 if an Illinois resident went to another state to get a d i vorce from an insane spouse and returned to Illinois afterward, the residency question could affect tlie validity of tlie divorce. In Illinois an insane spouse can be sued for divorce on one or more of the eleven grounds that are allowed. Even then, tlie grounds must pre- date the time the spouse was officially declared to be mentally incompetent unless they occurred during a "sane" interval. And before divorce proceedings can get undeiway a "guardian ad- ltem" must be appointed to represent the insane person's interest. —Illinois State Bar Association Sunday, Jan. 5, 1569: 9:30 a.m. Church School.
