Gable, board chairman of Stearns Coal and Lumber charged yesterday that proposed rules on selective timber-eutting in wild rivers areas are unconstitutional. He said a regulation proposed by the state Department for Natural Resources and Environmental Protection would give the department too much power. Gable, who owns several hundred acres in a protected wild river area in McCreary County, was the only witness at a public hearing conducted by the department. He said the proposed regulation does not define "selective cutting" of timber and would give the department absolute authority to determine, permit by permit, what kind of cutting would be allowed. He said the absence of specific standards raises the question of whether there are any circumstances under which the department would allow timber-cutting in a wild river area.

"We believe that Kentucky landowners are entitled to know in detail under what circumstances (if any) a private landowner is to be permitted to cut and market his own trees," Gable said. The regulation was drafted to implement the 1972 Wild Rivers Act as amended by the 1976 General Assembly. The law protects eight rivers and the land along the rivers from certain uses, such as mining and clear-cutting of timber, and specifies other activities, including selective timber-cutting, that may be conducted in wild rivers areas. The regulation would require anyone wishing to harvest trees to obtain a permit from the department. Applicants would have to submit plans for site preparation and reclamation and maps showing proposed changes.

A state inspection of the site would be required. The regulation defines selective timber-cutting as the harvesting or pruning of trees specified in the permit issued by the department. Gable's concern about the vagueness of the definition echoed that voiced by members of the state's Environmental Quality Commission at a meeting last month. Immigration official accused of selling visas to prostitutes MIAMI (AP) A federal grand jury has accused a U.S. immigration inspector of selling tourist visas to Argentine prostitutes so they could work six-month tours in the United States.

An indictment that Richard J. Harvin collaborated with Ernesto Torres-Alcala to get the prostitutes into Florida. Once there, each woman was issued a form allowing her to remain in the United States on tourist status for two weeks. The indictment said the women were then required to give Torres-Alcala $3,000 to pay for sixmonth tourist visas. Get hornworms. Get aphids. Get RAIN Insecticide. 3 And get the Penncap-M bonus: lower costs and reduced toxicity. Penncap-M is the bonus insecticide that protects your investment in tobacco from budworms, hornworms and aphids.

But Penncap-M gives you a lot more than great insect control. You get bonuses like extended control. To save on retreating. In one tobacco test, Penncap-M meant treating every 14 days instead of every 10. And per acre leaf return was increased over an untreated check.

Another big bonus- -less hazardous handling. Microencapsulation reduces toxicity. That makes Penncap-M less to handle and apply. And the skull and crossbones insignia is not required on the label. That's especially important in a worker-oriented crop like tobacco.

Plus Penncap-M is low in cost. So you get economical as well as effective, extended control. This season, don't gamble with budworms, hornworms and aphids. Get 'em with Penncap-M. See your dealer and order microencapsulated Penncap-M today.

It's the insecticide that gives you the bonus. AGCHEM DIVISION, 1630 E. SHAW FRESNO, CALIFORNIA 93710 (209) 226-8400.
