The FAA says the rule is a matte:- of safety, not discrimination. But pilots challenging it call it ar- bi :rary and cite examples of highly capable older fliers — including Sen. Instead of ferrying passengers around the world, the 62-year-old now mountain bikes and is planning a hiking trip this summer with his children. "Real disabled, huh?" Reiners asked in jest. The Federal Aviation Administration imposed the mandatory retirement age in 1959. It reviewed the limit in 1995, but instead of re- vising it, it extended the "Age 60 Rule" to some commuter airlines not previously covered. The FAA argues that it cannot ensure that pilots over age 60 will not be incapacitated by a heart attack or suffer from a subtle loss of their mental capabilities. The rule subsequently was challenged by Reiners, Philip Shaw, a Continental Express pilot, and the Professional Pilots Federation. They contended the rule violated the Age Discrimination in Employment Act, a 1967 federal law which protects workers over 40 from employer bias. The challenge initially was rejected by a 2-1 vote of the U.S. Circuit Court of Appeals for the District of Columbia. "Nothing in the (1967) act can plausibly be read to restrict the FAA from making age a criterion for employment when it acts in its capacity as a guarantor of public safety in the air," the appeals court ruled. In dissent, Judge Patricia Wald noted a "growing trend among foreign aviation authorities to allow pilots over 60 to fly." The court case played out against a political backdrop. The 80,000-member Air Line Pilots Association challenged the "Age 60 Rule" all the way to the Supreme Court in the 1970s. Now it strongly favors it. Critics say that is because the majority of its members are younger pilots who benefit from the forced retirements. A senior pilot at a major airline can make over $150,000 per year, while a starting pilot at a commuter airline is paid in the teens. Dillard's is one of the largest department-store companies, with 272 stores, while Fair-field, Ohio-based Mercantile operates 103 stores such as Gayfers, Maison Blanche and Mc-Alpin's. The Milliken family, which owns 40 percent of Mercantile, will support the transaction — meaning Dillard's will likely win a regional chain long covet- ed by competitors, analysts said. The move is the biggest yet for Chairman William Dillard, who focused on opening stores ' and small purchases the past decade while rivals such as • Federated Department Stores ; aggressively expanded through 1 ' acquisitions.
