Buchanan 90, generally recognized as the first strip and auger coal-mine operator in Eastern Kentucky and the first to use trucks for transporting coal, will be buried today.

Buchanan, who died Wednesday night, won the landmark court case that lets strip miners disturb the land surface of others to mine coal obtained through broad-form deeds. The state Court of Appeals, now the Supreme Court, decided in favor of Buchanan against Rollie Watson, a Magoffin County landowner, in 1954. The court has repeatedly held to the position that owners mineral rights can recover coal without regard for the disturbance of land surfaces short of wanton, arbitrary or malicious conduct. Many landowners sold rights to the coal under their land many years ago, before the introduction of strip mining, and signed what have come to be known as broad-form deeds. The deeds do not specify a method for mining the coal.

Buchanan at one time owned the mineral rights to thousands of acres of coal, mostly in Perry, Knott and Letcher a daughter, Mrs. Terry Lynn Souders; weather two sons, John L. Hazelip Jr. and Bruce Arnold Wolfe her mother, Mrs. Sally Indiana zone forecasts H.

In the 1940s, when coal mines near rail sidings were being mined out and the demand for coal was stimulated by World War 11, Buchanan experimented with running a belt conveyor from the old Indian Head tipple near Hazard to a highway. The plan worked, and the coal trucking industry was born. He experimented with extracting coal at its mountainside outcropping with an auger in Magoffin County in the 1950s, and the strip and auger industry resulted. The same auger operation resulted in the court test of the broad form deed. Strip and auger mining now account for more than half of Kentucky's coal Trucks now transport coal to users all over the state and to rail and river terminals for transportation or shipment to other states and foreign countries.

Survivors include his wife, a son, I. H. Buchanan two daughters, Mrs. Joyce Spare, Hazard, and Mrs. Brenda Stacy, Lakeland, Fla.

The funeral will be at 2 p.m. today at the Engle Funeral Home chapel. Burial will be in Resthaven Cemetery at Jeff.
