Oct. 9 (API-Turpentine a change of zoning was acted upon. When the stop-work order was issued August 9, Bullitt, James J. Dunn, resident manager of the corporation, and other officials conferred with William Beatty, zoning-enforcement officer. They asked Beatty if it would be a violation of the order to go ahead and build the foundations so the excavations would not cave in.

Beatty, according to Bullitt, told them it would be no violation of the stop-work order "but if the entire commission decides against the company then the whole investment will be lost." Bullitt said he told Beatty it was a business risk and the company was willing to take it. Beatty said yesterday: "I did not say it would not be a violation of the stop-work order. I only told them they could proceed at their own risk." The commission last Thursday postponed any action on the company's request to rezone the land just outside Shively where the warehouse has been started. He made the statement in response to a charge last week by a committee of the Jefferson County Planning and Zoning Commission that the distillery was "very careless and negligent" in building a new warehouse in the county without a permit. raid Taxes to Shively Bullitt said the distillery officials believed the land on which two warehouses were begun was in Shively; that the company had been paying taxes on the property to Shively, and that a New York engineering firm obtained building permits for the warehouses from Shively.
