C-6 -THE INDIANAPOLIS STAR- THURSDAY, FEBRUARY 11, 1993 accuses rivals of secret deals ASSOCIATED PRESS Washington American Telephone Telegraph sought damages Wednesday from three competing long-distance companies that says violated the law by making secret deals with customers. It's the latest volley in battle with MCI, Sprint and other companies over public disclosure. says it is required to tell the Federal Communications Commission more about its contracts than are its rivals. MCI said is Just bitter about losing customers to MCI. The battle is over business customers who make individual contracts worth millions of dollars for long-distance service tailored to their particular needs.

The U.S. Circuit Court of Appeals, here ruled last November that all long-distance companies providing interstate service must file information about those contracts with the FCC. "When all long-distance companies file their rates publicly, customers can know the service offers available and make choices that best suit business needs," said Joseph Nacchio, president of business communications services unit. "Secret deals deny customers the advantages of competition." He said owns about 60 percent of the $30 billion, corporate long-distance market in the United States. complaints were filed against MCI, Sprint and WilTel.

charging the three companies have been able to undercut publicly filed rates by offering secret deals to selected business customers. MCI vice president Gary Parsons said, obviously has been stung by a continuing string of losses to MCI among its largest customers and is desperate to find some way to stem the flow." He said MCI files Information with the FCC that fulfills the commission's requirements for "non-dominant carriers." has said that those filings do not comply, however, with the appeals court ruling. Officials for Sprint and Wiltel did not respond immediately to requests for comment. fc I iff Funeral Announcements 120 Lost In Memorlam MOSLEY-ln loving memory of Jerr MOSLeY LOST 27. Hunt Club Apt. 924-1318 payers have used this year, a 4 Any worker who wanted to continue under the old withholding rates a forced saving program allowing the government Interest-free use of money could do so by filing a new W-4 form with the employer. Although there are no official figures, payroll processing companies estimate about 7 percent took that option. Bush's withholding change means about 12 percent of tax filers will lose the refund they otherwise could have anticipated.

Some workers who usually owe the government when they file will have to pay a bit more this year. Through Friday, the IRS had received almost 14.6 million returns, a 13 percent drop from the 16.9 million received through Feb. 7, 1992. Processing of returns was down barely, to 6.8 million. More than 2.3 million qualified for refunds, up 8 percent from 2.5 million last year.

Fully one-third of the returns 4.8 million were filed electronically, compared with one-quarter, or 4.2 million, at this time a year ago. In electronic filing, a return prepared by the taxpayer or by a professional is sent directly into IRS computers by a transmitting company. This results in fewer errors, far less paper work for By JIM LUTHER ASSOCIATED PRESS Washington Early tax-return filers are getting even larger refunds this year despite the withholding reduction imposed last March by President Bush. Through Friday, refunds were averaging $1,140, compared with $1,124 for a comparable period of 1992. However, IRS spokesman Don Roberts said, "We may see that average decline in the new few weeks." He said one reason for the larger refunds is the continuing growth in the number of taxpayers who file returns electronically up 14Mi percent from last year.

"Generally, electronic filers have higher refunds" and therefore tend to file earlier, Roberts said. As their numbers decline later In the filing season, so will the average refund, he said. Bush last year permanently reduced tax withholding from the checks of most low- and middle-Income workers in an effort to spur the economy by giving consumers an additional $2 billion a month to spend. That changed no one's tax liability; rather, it meant that refunds anticipated this year would be reduced by a maximum of about $298 for most married workers and $149 for singles. FAST Service Refrlo. Ranges, washerdrver By PETRA KAMINSKY DEUTSCHE PRESSE AGENTUR Duesseldorf, Germany Europe's steel industry is used to going through a crisis now and then, but the current collapse of orders, production and prices is hitting it particularly hard. Pessimists in Germany, the world's fifth -biggest steel producer, already have begun talking of an impending disaster. Western German steel companies in January produced 2.54 million tons of raw steel, the lowest monthly total In 10 years. Meantime, steel companies are wracking up losses, thousands of workers are being dismissed and entire factories are being shut down.

The Kloeckner-Werke company has filed for court protection, while the recently merged Krupp and Hoesch companies have announced temporary plant closings In Dortmund and Rheinhausen. "We have a crisis situation which is blacker than that of the end of the 1970s and early 1980s," said Ruprect Vondran, president of the steel manufacturers' association. Heinz Kriwet, head of the top steel firm, Thyssen, is going from pne crisis session to another, a major one being at the European Community to establish a system bf production quotas around which the industry can retrench. Vondran also is proposing that some companies should, provided financial Incentives, voluntarily quit the business, while the remaining firms would bid for their share of production quotas. The idea of quotas is bitterly opposed by the EC Commission.

anti-dumping tariffs stay put. It will mean that an additional 15 million tons of steel, instead of going to the United States, will flow to Europe. German steelmakers which produced 36.8 million tons in the West and 3 million tons in the East last year have contributed to their own problems by having too much extra capacity. But it is a problem throughout the EC, where the excess capacity is estimated at 25 million to 30 million tons per year. The German steelmakers' association criticizes the EC Commission for having contributed to the situation with Its subsidies, saying that since the late 1970s EC members' governments had provided some $76 billion "to conserve no longer viable capacities." Meanwhile, workers accuse steel industry managers of shortsightedness, a view the German Economics Ministry recently echoed, saying Europe's steel sector had not learned from past crises.

In any event, steel, which along with coal and iron used to fuel German industrialization, has shrunk massively, and has particularly changed the face of the Ruhr Industrial region. In 1970, there were 350,000 people employed in western Germany's steel branch, and by 1985, the figure had dropped to 214,000. By the end of this year, the level will be at about 144,000. Industry Commissioner Martin Ban-gemann and Competition Commissioner Karel van Miert did agree that money should be provided to help reduce job levels. At Thyssen, payrolls were cut by 3,100 jobs in the last quarter, at the same time that turnover dropped 14 percent. Through 1994, the Thyssen Stahl steel unit plans to cut 7,000 jobs, from current levels of 57,700. Kriwet now Is not even ruling out the possibility of divesting itself of the steel division.

In the view of German steel firms, an entire bundle of problems has contributed to the crisis. First, it was the economic slump. Compounding the problem are cheaper East European-made steel products flooding the European market, especially Germany. After agreeing that the East Europeans, badly In need of hard currency, should have access to the EC market, the German companies began demanding the EC combat what they saw as unfair trade practices as their own situation worsened. The latest Jolt is the move by Washington to impose punitive tariffs on steel Imports from seven EC countries, including Germany, and 12 other countries, for alleged BAKER CONTRACTORS 636-0495 uALcN C.
