Jim Smith said today he will reintroduce a bill to change Alabama's method of execution to lethal Injection and said he ii optimistic the Legislature will pass it.

The bill proposes that death be caused by an Injection of "an ultra fast-acting barbiturate combined with a chemical paralytic agent" The state's current method of execution is electrocution. Three other states have changed to lethal injection and the first person to die by that method, Charlie Brooks was executed Tuesday in Texas. Smith twice introduced his bill while he was "If your case came down to execution and Alabama law gave you the option between the electric chair or lethal injection, which means of death would choose?" In response, Tate said, "One chose the electric chair, 24 chose lethal injection and 18 inmates said they were undecided or it did not matter." Alabama's last execution was in 1965. Alabama law now calls for the more common method of death by electrocution. The state's bright-yellow electric chair, known as "Yellow Mama," is located adjacent to death row at Holman a member of the House but the House adjourned each time before voting on the matter.

He said he will introduce it again in a special sesiion next month. Meanwhile, in Atmore, Alabama's death row inmates were in a "subdued" mood following -the execution of Charlie Brooks Jr. in Texas, but most of them said they would rather die by lethal injection than electrocution, prison officials said. Ron Tate, prison system spokesman, said a deputy warden at Holman Prison asked 43 of Alabama's 53 death row inmates the following the question: Prayer plaintiff reduces claim Officials unidentified months away, attorneys said. Mobile County school board president Dan Alexander said Wednesday that Jaffree's withdrawal of the punitive damages was a sign of victory for the teachers.

"In effect, what Jaffree's saying is that we never did anything Alexander said. Jaffree, an agnostic, claimed his three children suffered emotionally in refusing to participate in school religious activities led by the teachers. After hearing the testimony during the trial, Jaffree conceded defeat while awaiting the judge's decision. However, his attorney, Ronnie Williams of Mobile, said the case would be won in the appeals courts. MOBILE (AP) A federal judge con-, sidering Alabama's school prayer case has granted Ishmael Jaffree's request to dismiss a claim for 1100,000 in punitive damages.

However, Jaffree's claim for $15,000 in compensatory was not withdraw. Punitive damages were filed against three Mobile County school teachers in Jaffree's suit challenging religious activities in county schools. U. S. District Judge W.

Brevard Hand granted Jaffree's motion to withdraw the $100,000 claim on Nov. 29. The motion was filed Nov. 23 following a four-day trial of the lawsuit that ended Nov. 18.

TUSCALOOSA County Sheriff Beasor Walker said the burial of the body, known to investigators only as "Jane Doe," is no indication that the investigation is halting. He said the body, which had been preserved for investigative purposes, was too badly decomposed to be of use in identifying it. "Of course, even with the burial of the body, the case will not be closed. We will continue to follow up leads and try to identify the body," Walker said Wednesday.

THE WOMAN'S age was estimated at 34 to 38, and investigators believed the body had been in the river two to four days before it was found near the Fosters community of Tuscaloosa County. Efforts to Identify the woman included sending a description to law enforcement officials across the and checking fingerprints against Federal Bureau of Investigation files. Judge E.H. Hawkins signed a petition Tuesday allowing the body to be buried. THE FUNERAL was scheduled this afternoon at Sunset Memorial Park.

Earl Mitchell, funeral director, said a local Baptist minister would conduct a memorial service. The county and the funeral home would share the cost of the burial, Mitchell said. Assistant U.S. Attorney Doug Jones said during pretrial hearings the government expected to prove that Sims was on the pot plane and that Dutton was at the scene to help unload the marijuana. Jones also said he would show that Dutton had agreed to store the marijuana at his home. BIRMINGHAM (AP) Two men scheduled to be tried Wednesday on drug charges entered pleas of guilty before a federal judge before the trial could begin.

The two were among five arrested when a plane loaded with $600,000 worth of marijuana landed in Decatur Sept 2. Kay Don Dutton of Moulton and Carey Sims of St. Petersburg, admitted they were guilty of conspiring to import marijuana. U.S. District Judge William Acker sentenced Sims to a year and a day in prison.
