"If possible, your assistance will be appreciated," the memo ended. As for Tubbs' recollection of a deal offered secretly by DeBruyn, DOC spokeswoman Pam Pattison said, "That's not true." She said the recommendation to promote Sgt.

Jeffrey Sewell instead of Tubbs or six others was made by a three-man promotions board. The board's evaluation showed Sewell, a white officer, had trained in military corrections and worked in a Navy brig with 400 prisoners for three years before his discharge and his employ- ment by the DOC in 1992. "Everybody starts out with 100," she said of the scoring process. "They look at the overall record of the Individual, if there have been disciplinary problems, if there has been absenteeism and how they have presented themselves over the course of things." Tubbs, who was passed over twice in prior efforts to make lieutenant, said any points he might have lost for disciplinary action and absenteeism would involve the disputed Incidents in his discrimination claim. He said It was unfair to him to include Unit Team Manager Evan Phemster as the promotion board's only black member.

Phemster, a defendant in inmate Bell's lawsuit, approved the move that put Bell and his pursuer in the same cell. As a shift supervisor who has worked in the state prison system 10 years, Tubbs said he was the senior and the most qualified applicant when the opportunity came. Britt belonged to a 24-year-old woman who was reported missing after the death was discovered. A check of dental records proved Tonya Diuilap was the woman whose body was found Nov. 8 along U.S. 20 In the Miller section of Gary, Lake County Coroner Dr. Thomas Philpot said Tuesday.
