OPINION Feb. 1, 1962 19223. In re Ordinance No. 464, Annexation vs. City of Jasper.

Dubois Circuit Court. Transfer denied. Achor, chief justice. The petition for transfer does not state sufficient cause for transfer. However, court does not approve language of Appellate Court which imports that compliance with Rule 1-13 is directory only and not mandatory.

The constitutional impediment upon the legislature (lazy ludge act declared invalid in Kostas case) does not stand in way of mandatory rule of this court.
