Bennett said White, a businessman, and Mrs. White, a nurse in charge of a hospital's surgical care unit, are too smart to forget about possessions on their bankruptcy petition. He pointed to the testimony of Herbert F.

Poston of Clearwater, who allowed his name to be used on a mortgage although he said he never gave the Whites money. He said the mortgage was "Just paper." U.S. District Judge Sarah Evans Barker advised the Jury to weigh Poston's testimony cautiously because he was testifying with immunity against prosecution. Linda L. Pence, Mrs.

White's attorney, repeated the defense used throughout the trial the couple disclosed most of the assets to their bankruptcy attorney, Mark A. Center, and that Center failed them because of substance abuse problems. Pence quoted heavily from the testimony of a Chicago attorney, whom Barker accepted as an expert in bankruptcy, to show that Center's inattentiveness was unethical and that he may have committed malpractice by leaving some duties to a paralegal. SMULEVITZ STAR STAFF WRITER A federal court Jury early today convicted a Yorktown husband and wife on two counts of bankrupcty fraud.

The jury, which began deliberations about 5 p.m., returned its verdict against Phillip R. and Beverly Sue White shortly after midnight. Each could be fined up to $5,000 and receive up to five years in prison on each count. The Jury found that the Whites shielded assets from creditors by concealing possessions from bankruptcy court and fabricating mortgages to discourage the court from seizing and selling their homes at Yorktown and in Florida. The couple were the second of three brothers and their wives to be tried on similar charges associated with personal bankruptcies filed after the family-owned business.

White Petroleum also went bankrupt. Richard and Judy White of Middletown were convicted in March of bankruptcy fraud. Daniel and Judith White of Shirley are slated for trial Monday. In closing arguments. Assistant U.S.

The body of an 8-year-old Fort Wayne girl missing since Friday when she failed to return home from a friend's house was found Monday in a ditch next to a rural DeKalb County road. An autopsy was being conducted Monday evening on the body of April Marie Tinsley to determine the cause of death. DeKalb County Prosecutor Paul Cherry said there were no obvious wounds.

The body was found by a Jogger on County Road 68 about a mile west of Spencervllle, 18 miles northeast of Fort Wayne. State police, the DeKalb County Sheriff's Department and the FBI are investigating. The girl was about two blocks from her home Friday when she left for another's friend's house to pick up an umbrella before continuing home. She never reached the second house. Her father, Mike Tinsley, reported her missing about 3 p.m.

A resident in the area in South-central Fort Wayne told police he had seen a white male force a girl into a pickup truck Friday afternoon. BATHTUBSHOWER TILE UGLY?
