Drury, who since 1981 has not paid a fine for parking tickets he has received at the county courthouse in Lebanon, has been summoned to City Court on at least 20 of the violations. That's how many city officials say he accumulated last month alone, but the judge will have an opportunity to challenge an ordinance he contends is invalid. Truitt said Friday that Drury could have received as many as 200 tickets since January. Drury said he believes he has not violated the city's parking ordinance, under which his car has been ticketed regularly for four years. He also contends the ordinance is not valid and says he will hire a lawyer to prove it if necessary. "I have problems with this ordinance in that they are treating people unfairly, and not just me but everyone," the judge said. I don't feel anybody is above the law, including me.

But I don't think I'm parking illegally, and I don't think their ordinance is valid." Drury said his car has been ticketed regularly since the downtown parking ordinance went into in 1981 and that he has never paid a fine. He said this is the first time he has been summoned to court for non payment. The city gives each county officeholder two permits, which allows for undisturbed parking around the courthouse. Drury says he gives the permits to his court employees because he is not around the court house long enough, except for trials, to take advantage of them. "Is it fair for a Circuit Court judge in any county to go out every two hours to move his car so he won't get ticketed? If I'm in the middle of a trial am I supposed to tell the jury, 'Excuse me, but I've got to leave so I can move my car so I won't get a parking It's just ludicrous." The city ordinance allows up to two hours of continuous parking in.

The judge declined to elaborate on why he thinks the ordinance is invalid, saying he wants to discuss the matter with an attorney. Yet, he added, his car was ticketed three times.

City Attorney Truitt said the city, under new Mayor Ann Garof-folo, hired a full time employee last summer to enforce the ordinance. He said the position was added to appease downtown merchants, who complained that rampant violations were denying valuable parking space to prospective customers. Not only are there more tickets being issued, he said, but more people also are not paying. He noted that Drury is not the only person who has been summoned for nonpayment, but he invited the judge to pursue his intentions to challenge the ordinance in court.
