State. Delaware Superior Court. Appellant's petition for re-hearina denied. Hunter, iudge. Appellant contends court did not discuss matter in brief, and contends form of verdict did not follow exact lanquage of habitual criminal count.

During trial state presented certified records showing the two convictions charged, and two unrelated convictions which were admitted without proper ob-lection, and appellant contends the lury should state the two convictions referred to In their verdict. A lury may return general verdict of guilty as charged, and there Is no requirement that verdict must recite entire charge. There Is no Justification for different rule In liabitual criminal cases. If appellant had obiected to the introduction of the two records showing the unrelated convictions he might have confined iury's consideration to the two convictions eharoed. Unless a verdict Is so defective and uncertain that no ludoment could be rendered thereon, a motion for new trial will not be sustained, APPELLANT COURT May 12, 1969 20784.
