Givan, judge Appellant was charged with involuntary manslaughter, reckless homicide, causing death while driving under influence, and driving under influence, and was found guilty of causing the death of aother person while driving under influence of intoxicating liquors. Appellant contends It was error to permit uniformed officer 10 sit at counsel table during, trial, and that it was prejudicial to permit uniformed officer to testify for state. Appellant contends that since the officer was armed, it gave more credence to testimany.

Many officers are required 10 wear uniform on duty. and this includes side arms, and it would be ludicrous for this court to hold that such officers change to civilian clothes, and all citizens are aware such officers wear uniforms, and their presence in court is common occurrence. There 15 no manner of knowing whether uniform helps, hinders, or is of no consequence to state's case. The court has discretionary power as to who is permitted in court room. and this court will adopt no rule which unreasonably would hamper the trial of criminal cases as appellant contends.

Total first aid runs, 21. 2 Shot In Dispute Over Rent Payment Two persons were shot last night during a dispute over payment of rent in an apartment building at 2235 North Kenwood Avenue, police said. The victims were Miss Ernestine Franklin, 22, of the Kenwood address, and Lawrence Gorman, 31, 7100 Rue Lemans Court. U.S.

Threatens Road Fund Cut Indiana was one of five states threatened yesterday with a 10 per cent cut in Federal highway funds next year because the government said they ignored tough Federal requirements. Governor Edgar D. Whitcomb's office had no immediate comment on a registered letter from United States Transportation Secretary John A. Volpe which said Indiana's penalty would be about $8.6 million, but offering to consider any state appeal personally. The State Highway Commission already is working on a proposed strengthened billboard control program in view of the admitted weaknesses of a billboard law passed by the 1971 General Assembly.

The states other than Indiana are Georgia, Kansas, Montana and South Dakota. Miss Franklin was wounded twice in the front of the head, either by slugs or ricochets. Gorman was wounded in the back of the head and right shoulder. THEY WERE taken to Marion County General Hospital. The hospital refused to disclose their conditions last night.

Detective Harry T. Lovell said a custodian at the apartment was being sought as a suspect in the shootings. Lovell said the custodian attempted to collect advance rent from Miss Franklin about 9:30 p.m. and drew a pistol when she refused to pay. She said the apartment owner had told her not to pay the custodian.

Gorman, whom Miss Franklin knew slightly, was passing by, intervened in the argument, then tried to leave, police said. Witnesses told police they heard Gorman say, "Well, if you're going to shoot me, you're going to have to shoot me in the back." GORMAN was wounded as he walked away. Miss Franklin ran and also was wounded. She ran to 22d and Meridian streets where an off-duty Marion County sheriff's deputy saw her and summoned help. Lovell said slugs were found outside Miss Franklin's apartment.
