Assignment of errors. Submitted under Rule 2-14. OPINION Feb. 9, 01967 20312. Hornung, executor, et al vs.

Biggs. Decatur Circuit Court Judgment affirmed. Cook, J. The executor brought action for partition, and appellee cross-complained In quiet title. The evidence was presented by stipulation, and only question Is interpretation of clause in will of decedent givIng sisters title to land.

One of sisters died, and appellee claimed as sole owner of real estate. While loint tenancies are looked upon with disfavor, and the testator did not use the terms jointly or joint tenancy in will, the words "upon the death of one, the whole interest shall vest in the surviving sister" clearly expresses the quality of survivorship, and the nature and quality of the estate devised. To construe the will in any other manner would render Inoperative the words of the will above set forth. All of the prerequisites of a loint tenancy set forth in the case of Case vs. Owen, 139 Ind.

22 are met, and the language of the will clearly intended to create a will in joint tenancy. DIVORCE SUITS CIRCUIT COURT Carolyn S. Davis vs. Kenneth L. Davis.

Dropout, 16, Finds School Beats Jail A 16-year-old unemployed high school dropout yesterday decided he'd rather go back to school than to jail. William T. Sharp of Municipal Court, Room 6, gave the Thomas Carr Howe High School dropout, William E.

Scott, 119 North Gladstone Avenue, this alternative: spend 28 3 days in jail or give school an honest try for 180 days. Scott chose the latter. Scott, who left school last year, was arrested Feb. 1 outside Howe where police he was driving on the wrong side of Julian Avenue to pass about 50 waiting cars. He was charged reckless driving.

After failing to appear in court Wednesday, he showed up yesterday and was fined $50 and costs, his driver's license was suspended for six months and he was given 30 days in jail. Judge Sharp, suspending 28 days of the jail sentence, gave Scott 180-days probation, during which the remainder of the jail sentence will be served if the boy does not return to school. Scott had registered at Harry E. Wood High School for this semester, but had never attended classes, Wood officials said. Husband Admits Guilt In Fatal Stabbing Of Wife Howard G.

Campbell, 35 years old, 4119 Spann Avenue, pleaded guilty yesterday to the second-degree murder of his 47-year-old wife, Glenna, last August. Mrs. Campbell was found by neighbors in the driveway of the home next door where she lay fatally stabbed. Authorities said her body bore 16 wounds, two of them in her neck. Campbell was found in the basement, his wrists and throat slashed.

He later was indicted on a first murder charge. Judge Saul I. Rabb of Criminal Court, Division 2, called for a precommitment investigation. J.A. To Hold Adviser Recognition Affair Junior Achievement Of Indianapolis Inc.

(UPI) An estimated 3,500 University of California students and faculty members marched on the state capitol yesterday to protest Governor Ronald Reagan's proposed budget cuts 1 for higher education. The governor made a surprise appearance on the capitol steps and urged the demonstrators to face the state's serious financial problems calmly.

"WE ARE FACED with a very serious temporary problem," Reagan said. The demonstrators marched to the capitol to protest Reagan's plans to trim the state's higher education budget by $64 million and to object to the firing of Clark Kerr as president of the university. Reagan said his cutbacks might "momentarily delay progress" at the giant ninecampus university but said they were made necessary by the state's "dire" financial situation. "I ask you in all fairness to weigh carefully both sides of this question," Reagan said. The crowd applauded politely.

Redistricting Heat Put On By 3 U.S. Judges Three Federal judges who have jurisdiction of Indiana Congressional districting yesterday put added heat on the Indiana General Assembly to realign the districts under new criteria, when they enjoined any further elections under the 1965 districting. The order was reported by Robert G. Newbold, clerk of United States District Court for Southern Indiana, after all three judges signed it. It states that the court will not provide any guidelines to the legislature.

There were earlier indications from the court that this would be the case. Judges in the case, who earlier upheld redistricting and then were ordered by the United States Supreme Court to hold further proceedings, are Cale J. Holder and S. Hugh Dillin of the Southern District bench, and Win G. Knoch of the Seventh Circuit Court of Appeals at Chicago.
