The evidence was presented by stipulation, and only question Is Interpretation of clause In will of decedent giving sisters title to land. One of sisters died, and appellee claimed as sole owner of real estate. While loint tenancies ere looked upon with disfavor, and the testator did not use the terms lointly or joint tenancy In will, the words "upon the death of one, the whole Interest shall vest In the surviving sister" clearly expresses the quality of survivorship, end the nature end quality of the estate devised. To construe the will In any other manner would render Inoperative the words of the will ebove set forth. All of the prerequisites of loint tenancy set forth In the case of Case vs.

Owen, 139 Ind. 22 ere met, end the language of the will clearly intended to create a will in joint tenancy. DIVORCE SUITS CIRCUIT COURT Carolyn S. Davis vs. Kenneth L.
