WASHINGTON, Dec. creaaea provided in eleven aectlons of tha Eastern and Western class freight rat schedulea today wera suspended for seven months by the interstate commerce commission They would have becom effective tonight at midnight. The commission acted as a result of serious objection to several phases of the new rates, wnich included some decreases. Among the suspensions was that of increased rates on potatoes from Western trunk line territory to Illinois. Nebraska potato growers objected seriously to th increased rates.

Rates on cotton from Arksnsss, Louisiana and Texas to th East and New England by way of New Orleans, alao were held up. Probe Be Started. Tha commission more than a year ago prescribed a new basis ot rate making for railroads in what is known as the Eastern, or official classification territory, and Western trunk line territory. These ratea taken aa a whole, the commission has said, resulted in increases of approximately a year in th East and $12,000,000 in the West. Investigation into tha individual Items will be started at one by th commission.

Reports may com be fore tht end of tha suspension penoa or it may be extended if hearings can not be completed earlier. Class and commodity rates by way of Lake Michigan and Lake Superior ports on rail and lake and rail-lake rail traffic both eaitbound and west bound between Eastern and Western points were among the schedules. Preterit Rates Retained on Shipmentt in State An order suspending alt new In creased class freight and shipping rates on all articles moving on class rates or percentages was issued yes terday by the publio service eommis sion. The suspension order retains the present rates on shipments within the state. The new class rates were estab lished by the interstate commerce commission and will go into effect today.

The Indiana order does not affect Interstate rates. The suspension order follows a similar action by the Illinois public service commission, according to O. R. Llvlnghouse, commission traffic manager. -Grounds for the order were that it will keep Indiana and Illinois rates on an equality and that the increased rates should not be come effective In Intrastate com mnrce without a hearing.

1333. AGTIOn I POUR PLEfl CLEARED Commission Holds North Manchester Case Not in Scope of Utility Law. An opinion explaining; action of the public aervice commission last Friday in dismissing the petition of the town of North Manchester to acquire by condemnation property of the Northern Indiana Power Company was issued yesterday by two members of the commission. Commissioner Harry K. Culhbert-son wrote the opinion and Chairman John W.

McCardle concurred. These two, with Jere West, passed the dismissal order. Howell Ellis snd Frank T. Singleton, commissioners, dissented. i North Manchester had proposed to acquire the electric utility property of the northern Indiana company used and useful in serving patrons within the town and operate it as a municipal ay stem.

'The action was filed under a provision of the Shively-Spencer utilities act providing for such action by municipalities. The utility filed a motion taking dismissal of the town's petition. The public service commiaaion granted thla motion. Friday's order did not ax-plain the commission's action. Not Wlthia Scope of Law.

The Cuthbertson opinion contained two major propositions: 1. The situation at North Manchester does not come within the scope of the condemnation provisions of the utility law. 2. The public service commission' a position in the past naa Deen 10 en court Re expansion of electric Utili ties into lane svstems. As interpreted in the opinion the condemnation law gives municipal governments the right to condemn for public ownership a utility which has the major portion of its property used and useful for serving that munlcipalitv-within the corporate limits nf tht citv.

"This commission, by knowledge of its records and by admission of the parties, knows that the major part of the Drooertv of respondent utility. used in servicing North Manchester and the inhabltanta thereof is not located in the town of North Manchester, but that tha distribution system in said town is only a small part of a distribution system served from centrslized power plants," the order stated. Fart of Chain System. North Manchester ia part of a chain distribution and production system similar to the "south system" of the Public Service Company of Indiana, in which the utility recently sought to establish group rates ior various cities and rural districts within the syatem. The order discussed various public service commission orders which showed that its established policy was to encourage the growth of elec trical properties.

Mr. Cuthbertson showed that. Mr. Singleton, who voted against the North Manchester order, had approved the various ex pansion orders issued by the com mission. It showed also thst Mr.

Ellis, likewise, had approved theae orders. The commission order which ap proved ourchsse of the North Man chester property by the Northern Indiana Power Company from the Bip- pus Utilities Company in 1923 was quoted in the opinion as holding that: "A new superpower plant located on the Wabash river near Terra Haute (the Dresser plsnt) is nearing com pletion, having an initial installation of. generating equipment ot 40,000 k. w. Benefit to Consumer.

"The transmission lines connecting this plant with tha system of petitioner are already completed or ara nearing completion and the system of petitioner including the properties to be acquired will be served by the economical operation of tht present planta in connection with the operation of the new superpower plant, tn the advantage and benefit of the consumers and the companies," it further is quoted. "The above is an illustration of the encouragement in the progress made in the development of electricity and the electric aervice to bs rendered the public throughout the state ot Indiana, and not only the order referred to, but consistently since the issuance ot that order htve larger generating plants been built and constructed and transmission lines constructed throughout the state and all of such construction sanctioned by the public service commission of Indiana by authority or tne sniveiy' Spencer act," the opinion held. GREENCASTLE, Dee. gang of, Bva men who tortured and robbed Lewis O'Connor, 59-year-old Eel river farmer, last night, was being hunted by Putnam county officers tonight. Leaving on man for a lookout, four of tha men forced their way into O'Connor' a home and tied him to a bedpost, after which they beat him about the head and held burning paper to hie body in an effort to make him disclose tha hiding place of a large amount of money they be lieved he kept aecreted at the house. Finally they ransacked tha home, took $15 in currency and a gun, and after torturing; O'Connor further, left. They are believed to be the men who robbed the Cataract general store recently, and officials also believe they may be authora of several crimes in thia district.

O'Connor, after freeing; himself, made his way to the home ot a brother, and was given medical attention. He is expected to recover, velopment of tha Chicago District Electrio Generating Corporation in tha Calumet district and showed that this development was approved by tha commission through orders authorizing Issuance of large security issues from time to time. He pointed out thst these orders met with the approval of Mr. Singleton and Mr. Ellis.

Summing up the commissioners' views, the opinion said "If a law is to be administered by any branch of our government that branch of the government charged with the administration of that law must consistently travel in one direction and can not, with justice to the public and th citisena of this state, build up today and tear tha same thing down tomorrow. In other words, it is impossible for any administrative branch ot our government to attempt to travel in two directions under the authority of the same law. If the petition of the town of North Manchester In this case were sustained and authority conferred upon that town to purchase tha uaed and useful property within that town now owned by the respondent, a precedent would bV set whereby every city and town in tht state of Indiana could purchase th used and useful property within that municipality and adjacent territory, Install their own Individual generating planta and leave all of tha transmission ayatems which have been built up throughout these years and all the large centralized generating plants built up throughout these years as property of no value and of no use to the public in the state of Indiana, the securities issued to pay for the conatruction of such a system would be of absolutely no value whatsoever and all of the recognized value of centralization of generation of electrical power and the conveyance of the same by transmission systems would be done away with. the development of territory, both agriculturally and industrially, would cease and Indiana would step back twenty years and all of the progress made during: those years and recognized as one of the very vitals of the future welfare of this state would go for naught." Issue Separate Opinions. When Mr.

Ellis and Mr. Singleton dissented from the recent commission order, both issued separate opinions.
