Littell based his action on a column and radio broadcast by Pearson in 1949. The jury failed to make its decision on the radio suit and made the award on the basis of the column action. In the column, Pearson said the Justice Department was casting a "quizzical eye" at Littell because of reports he was acting as an agent for the Dutch government but had not i registered as one.
