Walker will decide Monday whether to permit the release on bond of Richard Millinder, 22, with slaying his neighbor, Pay Gates, last May 8.

Claiming the young road worker has been held "unjustly" in the Centre County jail, Defense Attorney Lewis O. Harvey obtained a habeas corpus hearing yesterday. Millinder was committed to jail without bond last month to await grand jury action after police said he signed a statement declaring he killed the Gates girl because she resisted his advances after giving him a "lift" in her automobile. State Police arrested Millinder, claiming he could not account for five minutes of his time on the night the girl was slain in a lonely lane near her home. The police still are seeking to solve the mystery of the slaying of young Rac.iel Taylor, State College co-ed, five weeks before Miss Gates was killed.
