(1) Appellant ruled claim against appellee estate for $5,583 for treatment and maintenance of decedent in state insane asylum from March 6, 1917, to March 29, 1940. The claim was disallowed, and the trial court held pay only after June 10, 1935. for $1.249.29 could be recovered. being at rate prescribed by statute, and so instructed the Jury. Appellee contends that the motion for new trial and appeal presents no question, as the real question is the amount of recovery and not the exclusion of relator's evidence of the claim for the time prior to 1935.

But the court holds that the amount of recovery is correct on the evidence admitted, and that appellant has properly presented the question. The fact that the relator filed motion for directed verdict for the amount that he was permitted to introduce evidence to support, does not bar him from his motion for new trial for exclusion of the evidence.
