Eagle vs. State. Parke C.C. Affirmed. Richmaa, C.

J. (1) Appellant entered a plea ot guilty to a charge of automobile banditry, and was sentenced to 23 years in State Reformatory. About a month later he Bled a petition to vacate the Judgment, and to change nis plea to not guilty. After a hearing the petition was denied. "The question for the trial court was whether appellant entered his plea ot guilty 'freely and "The question for this court is whether the trial court's denial of the petl-tion was an abuse of a sound Judicial discretion." The court reviews the showing by tbi record, showing conflict In appellant's testimony on direct and cross-exam-lnation.

Rich-man, C.J. U) Appellant hied an information seeking to have James A. McOor-mirk cited for contempt in an abandonment of appellant's appeal. McCormick filed a return showing that Arthur J. lies had Instigated the action of appellant, and was really responsible for the acts complained of by appellant against McCormick.

lies was ordered to file a return, which he has done The whole showing is not complimentary to any of the parties to the controversy, hut shows pettiness, etc. but there is no such showing as will cause the Supreme Court to punish either McCormick or lies, but the proceeding Is dismissed. The term ended during trial, and it was not error to make a nunc pro tunce entry showing the continuance of the trial on the several days in vacation to finish the hearing and final decision in vacation. The statutes relating to holding of court in vacation are stated and discussed. Ihe special findings support the conclusions ot law.

Discharge of Policemen and Appeals. 27860. Zellers et al vs. City of South Bend. Elkhart SC.

Affirmed. O'Malley, J. (1) The appellee filed charges against appellants, as police officers, of conducting them5elves in a manner unbecoming to officers and gentlemen, and on hearing the charges were sustained and appellants wese discharged. They filed an appeal, and on change of venue it went tu the court below, which sustained that action Appellants filed their motion for new trial, which was overruled, and they appealed. All assigned errors other than the overruling the motion for new trial are mere surptussage, and present no question.

for 11.249 28 could be recovered, being at rate prescribed by statute, and so Instructed the Jury. Appellee contends that the motion for new trial and appeal presents no question, as the real question is the amount of recovery and not the exclusion of relator's evidence of the claim for the time prior to 1935. But the court holds that the amount of recovery is correct on the evidence admitted, and that appellant has properly presented the question. The fact that the relator filed motion for directed for the amount that he was permitted to Introduce evidence to support, does not bar him from his motion for new trial for exclusion of the evidence. The statutes relating to pay for care of inmates at state insane asylums are reviewed "It follows therefore that the court erred In excluding the testimony as to the, cost of the care and maintenance under the 1917 act as amended The decedent left a sister surviving.

The appellant had the burden of proving that the decendent's estate was not needed in whole or in part for the support of this sister." As to the construction of the statutes construed, read the opinion. -Courts and Jurisdiction Jury Trial 27854. Sikich et al vs. Sprlngmann. trustee.

One form found in butterfat, fish liver oils and the livers of animals, is the vitamin itself. It is made by the animals from the other form which is found in vegetables and fruits. This form is called carotene because carrots are the vegetable which contains the greatest amount of it.

It is present in all fruits and vegetables which have a bright yellow or green color. This Is why we say that a colorful diet is a healthful diet. Human beings, like animals, store Vitamin A in the liver and when the diet does not supply enough, these stores are used up. When that happens the deficiency disease begins to appear. The first symptom is night blindness.

This means that the eyes cannot change easily from bright to dim lights and, as it gets worse, the eyes cannot see well in dim light at all. Later a disease of the eyes may appear, which is a permanent injury to the eyes, and, if not checked, results in blindness. It is called xerophthalmia. Lack of Vitamin A also affects the health of the linings of the nose, mouth and passages used for breathing. It lowers the resistance to infections, especially of the respiratory type, as colds, Influenza, etc.

It also affects the surfaces of ali internal organs. It may cause muscular weakness, poor growth and hinder tooth and bone development. Vitamin A is very important to the newborn baby and to the woman who is pregnant or nursing a child. Daily requirements of Vitamin A are measured in International Units. This is equal to 0.0006 milligrams of pure carotene.

The best way to measure the daily needs Is to compare the amount in common foods with the daily requirements, as follows: Children between the ages of 2 and 14 years require the amount of Vitamin A contained in: 1 serving green or yellow vegetables 1 egg 1 quart of whole milk Adult needs can be supplied by: 1 pint milk 1 egg 2 pats of butter 1 serving green or yellow vegetable Common foods which may be substituted are shown in the following table: International Foods Units 1 cup milk 460 1 cube cheese, 114 inches 682 1 egg 540 1 ounce liver 1,418 1 tablespoon butter 600 cup cooked greens 13,000 Vz cup stewed apricots 3,442 4 medium stewed prunes 715 cup cooked 1,870 1 cooked sweet potato 1,700 1 banana 280 1 medium tomato, raw 1,020 1 tablespoon cod liver oil 3,585 Vitamin A is not dissolved by water, but by oil. It is not destroyed by boiling or exposure to air, but is affected by cooking in fat or oil. Vitamin This vitamin is associated with Vitamin A because both are carried In fats, especially fish liver oils. Vitamin differs from other vitamin because it can be provided by sunshine. The skin contains a substance which the ultraviolet rays from the sun (or sun lamp) change into the vitamin.

The effect of these rays Is hindered by clothing, window glass or dirty, smoky or foggy air. They are most efficient during the summer and in the middle of the day when the iun is most directly overhead. Too much exposure to the sun's rays may harm the skin. Vitamin is necessary to everyone, but especially to growing children and pregnant or nursing women. It enables the body to make use of calcium and phosphorus to build and maintain good bones and teeth.

The body cannot use these minerals properly without Vitamin nor can it build bones and. teeth with Vitamin unless it has sufficient calcium and phosphorus. The disease caused by a lack of either the vitamin or minerals is called rickets, and may result In deformed bones, teeth or other structural defects. Vitamin is found in few natural foods. Fish liver oils are the richest sources.

Fat fish, beef, lamb or pork liver, eggs, butter and cream furnish small amounts. Milk, fresh and evaporated, and a few cereal products are being enriched with Vitamin either by irradiation through exposure to ultraviolet rays or by the addition of Vitamin obtained from fish liver oils. The growing child and the pregnant and nursing woman should have a daily minimum of one or two teaspoonfuls of cod liver oil or its equivalent Other adults can gain added protection to health by taking two or three tea-spoonfuls of fish liver oils a week. Vitamin Ascorbic acid gets its name from the fact that it was first discovered as a cure for a terrible disease common to sailors on long voyages where they could not get fresh fruits and vegetables. Long before Vitamin was discovered, it was found that British sailors kept free from scurvy by the addition of lime juice to their rations.

Thus they came to be called "Limeys." Scurvy is now seldom seen in this country. But many people suffer from unrecognized deficiency of Vitamin C. "Spring fever" restlessness, irritability in children and a general rundown feeling may be due to a lack of this vitamin. If it continues, the teeth and bones may be damaged and the blood system weakened so that it cannot fight infections. Ascorbic acid is used in the body in forming healthy tissue around certain cells, as the marrow in the bones, the dentine that makes up the greater part of the teeth, the walls of the capillaries or tiny blood vessels and other connective tissues.

If it is lacking, there may be soreness of the joints, sore, bleeding gums, weakness and a tendency to bruise easily. Serious deficiency may result in scurvy. Citrus fruits are the best source of Vitamin A. An eight-ounce glass of orange juice will furnish 100 milligrams, or more than the daily requirements for an adult. The United States Children's Bureau recommends giving strained orange juice, tomato juice or other source of Vitamin before the end of the first month, beginning with a teaspoonful a day, and gradually increasing until two tablespoonfuis are given twice a day from the third month on.

If tomato juice is given, twice as much is needed. Daily needs in ascorbic acid are shown by the following table (ascorbic acid is measured in milligrams the head of a common pin weighs one milligram): Person Milligrams Man, moderately active 75 Woman Moderately active 70 In pregnancy 1 100 In lactation 150 Childuen Under one year 30 1-3 years 35 4-6 years i 50 7-9 years 60 10-12 years 75 Girls, 13-20 years 80 Boys, 13-15 years 90 Boys, 16-20 years 100 These requirements may be supplied by the amount of ascorbic acid in common foods as shown by the following table: Food Milligiams grapefruit 38 Vi cup tomatoes 25 cup iemon juice 56 cup canned pineapple 7 10 large strawberries 35 cantaloupe 60 Vs cup sliced fesh pineapple 19 1 medium baked potato 6 1 raw green pepper 120 cup cooked spinach 12 1 cup cooked kale 50 1 cup chopped raw 71 cup raw cabbage 13 cup cooked beet greens 24 cup cooked turnips 14 Properly canned fruits and vegetables retain most of the ascorbic acid and orange juice for breakfast may be prepared the night before and kept covered in the refrigerator. Ascorbic acid Is destroyed by long cooking or by the use of soda in the cooking water. It dissolves in water and should not be poured away. It Is destroyed by long exposure to the air.

Fruits and vegetables for salads should be cut up just before they are to be served and should never stand in water. All tables taken from Food and Nutrition.
