TMIh WEATllEll And Humidcr A New York attorney accused the Cincinnati Board of Education Wednesday of a "clear record of discrimination by gerrymandering altering district lines." Lewis M. Steel made his charge before the U. S. Sixth Circuit Court of Appeals here at a hearing on a suit against the board by Negro parents he represents for the National Association for the Advancement of Colored People.

The suit, filed November 3, 1963, was appealed from its dismissal last year after trial before Judge John W. Peck of U. S. District Court. SCHOOL officials denied fostering racial discrimination in testimony before Judge Peck.

And the board's chief special attorney, C. R. Belrne, recalled before the three-Judge circuit panel that "the Ohio Supreme Court ruled 65 years before the U. S. Supreme Court did (in 1954) that a Negro child had every right of school attendance as a white child." The Cincinnati Board of Education has followed that policy ever since, he said.

But Mr. Steel contended "the great majority of Negro pupils attend predominantly Negro schools, while the great majority of white pupils attend schools that are virtually all white." HIS COCOUNSEL, Norris Muldrow, Cincinnati, claimed the board Increased the Negro ratio at Hughes High School by 15Co after it supplied white students, living nearby, with bus transportation to Aiken High School when that school opened four years ago. He said Negro students attending Hughes passed white students on their way to Aiken.
