The ruling upholds the referee who heard the case and reverses the Division of Unemployment Compensation and Employment Service, In a review of the case P. Stephen Stahlnecker, chairman of the board, states that the claimant was denied compensation by the service on the grounds that the unemployment for which heasked compensation was due to his "voluntarily leaving" work with his last employer, Conlon Coal Company, Hudson.

The claimant appealed from this decision of the service and the referee to whom the appeal was referred reversed the decision and ordered payment of compensation. The service then filed an appeal With the board of review. The claimant left his employment In the mines because of illness, the board of review finds. Two weeks later he returned and was given work. He complained to the foreman about ventilation, but nothing was done, according to the board's findings.

An altercation followed and as a result the claimant was dismissed after work. ing-one week, the testimony revealed. The decision of the board states: That the claimant's first leaving was voluntary cannot be questioned. However, the unemployment for which compensation is claimed la not due to his leaving on account ef illness but to his discharge from his new employment The fact that the employer may have dismissed bun because of his complaint Is, of course.
