North Hills, Pittsburgh 4-1 -MICHAEL PAOLERCIO The parents of four St. Xavier High School students are challenging In federal court an Ohio High School Athletic Association (OHSAA) rule which prohibits out-of-state residents attending private schools In Ohio from participating in athletics. The suit was filed in U.S.

District Court in Cincinnati last week by Dennis Alerding, father of Dennis a sophomore at St. Xavier, and Roger H. Moellering, father of David a junior, I ouglas a sophomore, and Gregory R. Moellering, a freshman. Both families live in Kentucky.

The suit was filed against the OHSAA, Commissioner Richard L. Armstrong and St. Xavier High School. In the suit, the parents claimed a rule adopted by the association in 1979 violates the students' constitutional rights because It prevents them from getting a complete education. Bylaw 4-6-10 of the OHSAA constitution states: "A student whose parents live In another state will be Ineligible for athletics in an Ohio member school." The parents are challenging the rule In federal court on a constitutional question because the OHSAA constitution states that: "Competitive sports are an inherent part of the total education program for students In secondary schools.

When properly organized and conducted, lnter-school athletics provide numerous opportunities for students to participate in activities which promote growth and development, teach social and recreational skills and develop leadership qualities." John E. Lange, attorney for the parents, said they will seek to get the residency rule declared unconstitutional by the federal court. "The parents feel their -students should be able to participate in the total program at the school," Lange said. He said the law was challenged in the state courts In 1979, but lost at the appellate court level. The state appellate court ruled that state courts should not interfere with the Internal affairs of a private organization as long as the rule was enforced uniformly.

Lange said the rule is a restriction on the students' freedom of travel between Kentucky and Ohio and denies the parents the right to choose a total educational program for their children consistent with their personal convictions and religious beliefs. -ALLEN HOWARD District Golf Thursday The Southwest District golf tournament will be held Thursday at Middletown's Weatherwax Golf Course. The state qualifiers will vary according to class. In AAA the top three teams qualify for state; In AA, two teams qualify to state; In one team qualifies to state. Unlike the sectional, however, only the tournament medalist and runner-up qualifies for the state fone or both are not members of qualifying teams.

The state tournament will be held on Oct. 14 and 15 at Ohio State University's Scarlet and Gray Golf Courses.
