B4 TUESDAY, JULY 26, 2011 LOCAL NEWS THE ENQUIRER Parker to get mental testing Rare request for evaluation by prosecutors By Jim Hannah COVINGTON - A judge on Monday ordered that Marion Lawson Parker III undergo a mental evaluation to make sure he is eligible for the death penalty. Kenton Circuit Judge Gregory Bartlett said it may be the first time in Kentucky that such a request was initially made by a prosecutor. Parker's lawyer later joined the prosecutor in seeking the evaluation. Commonwealth's Attorney Rob Sanders said he asked for an evaluation so that Parker wouldn't be able to chal Parker lenge any possible conviction and death sentence on the grounds that he is mentally retarded as defined by state law. In September, Cincinnatian Gregory Wilson got a judge to grant an indefinite stay on his execution after he claimed he was mentally retarded. It was the first time he had made such an assertion since he was convicted more than two decades ago in Kenton County of kidnapping, raping and killing Debbie Pooley, 36, of Covington. The stay challenged a traditional legal practice requiring defendants to assert a claim of a mental disability at least 30 days before their trial. Since the Kentucky Correctional Psychiatric Center in LaGrange can't complete the evaluation in time for Parker's Aug. 9 trial date, Bartlett ree-scheduled the proceeding to Oct. 25. Parker will now be tried during the same trial as his codefendant, Samantha Mayse, who is also facing the death penalty. Both are charged with murder, first-degree robbery and tampering with physical evidence. After Bartlett ordered the mental evaluation, Parker's attorney, public defender Joanne Lynch, filed a motion challenging the constitutionality of Kentucky legal definition of mental retardation as it applies to the death penalty. Kentucky law states that someone is legally mentally retarded if they score 70 or below on an IQ test. A hearing on the IQ question has been scheduled for Aug. 16. Lawyers for the state attorney general will likely travel from Frankfort to defend the constitutionality of the law. Two other codefendants have already pleaded guilty to avoid the possibility of a trial and being sent to death row. Patrick Cooke and Mary Ann Hartbarger pleaded guilty to facilitation to murder, first-degree robbery and tampering with physical evidence. They will be sentenced after they testify against Parker and Mayse. Prosecutors are recommending that Cooke and Hartbarger each spend 25 years in prison. Cooke would be eligible for parole after 12'A years; Hartbarger will be eligible for parole after 14 years. Prosecutors and police say the four planned to rob Shawn Davis, 28, at a Covington apartment but the robbery turned into a savage beating when Davis fought back. While pleading guilty, Hartbarger said Mayse lured Davis to the apartment on the promise of sex with her and Mayse. Parker came in to attack Davis. In his plea, Cooke admitted to holding down Davis as Parker strangled him. Hartbarger and Cooke both said they helped put Davis' body in a trash can and drove it to a remote bridge in Campbell County, where they set the body on fire. Parker's attorney is challenging an attempt by the prosecutor to also try their client during the same trial for killing a cellmate at the Kenton County jail. Authorities say Parker strangled Isaac-Jackson, a 40-year-old homeless man who was jailed on misdemeanor charges.
