FRIDAY, JULY 20, 2001 FN METRO THE CINCINNATI ENQUIRER Hagerty, 51, art department Hagerty, art Obituaries Mr. Hagerty in Montgomery, he earned a bachelor's of fine arts degree from Auburn University in 1972 and a master of fine arts degree from the University of Cincinnati in 1981. Mr. After teaching design Hagerty and drawing at Tuskegee University, and working as a graphic designer at the Tuskegee School of Veterinary Medicine, Mr. Hagerty was hired at UC in 1986 as the second full-time faculty member of the commercial art program.

He and Susan Wheeler, chair of the department and the only other full-time faculty member, worked together building it for the next 10 years. "There was so much to do and Bob was always willing to do what needed to be done and to learn what needed to be learned in order to keep the students current with the professional needs of today," said Ms. Wheeler. Mr. Hagerty received the University of Cincinnati's Faculty Achievement Robert commercial By Rebecca Billman ist and professor of art and visual communications at Raymond Walters College, died Tuesday at Hospice of Cincinnati after a battle with a brain tumor.

The Wyoming resident was 51. "He really was an extraordinary professor," said his friend and fellow artist, Lee Horvitz of Over-the-Rhine. "His students were quite loyal and taken with him. I'm not exaggerating when I say he really was beloved by his students because he was a genuine educator." Many of his students, as well as dozens of friends from across the United States, rallied around during his illness, said Mr. Horvitz.

"Bob had a real talent for friendship." Mr. Hagerty was "first-rate artist" who specialized in drawings "that were well-known for their sensitivity and depth," his friend said. "He was just a deep, profound person." Born in Charleston, W.Va., and raised The Cincinnati Enquirer LOCKLAND Robert Hagerty, art- helped build at UC Award in 1997 and the George B. Man weighed 80, was near death, authorities testify in neglect case Defense questions evidence gathering By Janice Morse The Cincinnati Enquirer HAMILTON While in the care of relatives in West Chester Township, a man with autism wasted away to 80 pounds half what the 6-foot-tall man weighed in 1998 and nearly died last fall, authorities say.

Now Kevin Jessie Smith, 23, lives in a Butler County group home, has a job and weighs a healthy 180 pounds and his brother and sister-in-law are facing felony charges. Keith Edmond Smith, 27, and his wife, Lakeah, 22, are charged with "failing to provide for a functionally impaired person," resulting in serious physical harm to Kevin Smith. Each also was indicted in March on a count of theft involving Kevin Smith's Social Security checks, authorities said. The couple appeared in Butler County Common Pleas Court for an evidence hearing Thursday. For four hours, lawyers argued whether certain evidence should be allowed in the couple's trial, which is set for Sept.

17 before Judge H.J. Bressler. The evidence hearing will resume Tuesday and continue "until we finish, however long that may be," Judge Bressler said. The couple's lawyers say their clients are not guilty and would never hurt Kevin Smith. The lawyers, Scott Blauvelt and Melynda Cook, also argued that some evidence was collected in violation of their clients' rights.

But Kacy Eaves, a Butler County assistant prosecutor, said photographs and statements that police and paramedics obtained should be admissible because emergency crews gathered that evidence in the normal course of their duties Oct. 16. At around 6:25 that evening, Keith Smith had called 911 after his brother collapsed and was having trouble breathing. When police and paramedics arrived at the home in the 9500 block of Triangle Drive, they found Kevin Smith unresponsive on a hallway floor, near his bedroom, which was soiled with human waste. "(Medics) weren't sure at the time whether or not he would live," West Chester Township Detective Dan Buschur testified Thursday.

Kevin Smith was hospitalized for two weeks and was in rehabilitation from November until March. Mr. Blauvelt and Ms. Cook peppered police with questions about whether they advised the Smiths of their rights, whether officers obtained a search warrant, whether they asked permission to take photographs inside the house and whether they had the residents' consent to search the premises. Officers testified that they took none of those formal steps because the Smiths did not object and because, at the time, it was unclear whether the circumstances were criminal.

Protesters want 'Family Council' out By Janice Morse The Cincinnati Enquirer NEW MIAMI Nearly a dozen protesters showed up for a village council meeting Thursday, bearing signs that called for members of what they call "the Family Council" to resign because of "mistreatment" of the village police department. The signs referred to four members of the six-seat council who are relatives: Patricia Lipscomb and Edith Cook, who are sisters; Mike Cook, Mrs. Cook's brother-in-law; and Paul Newton, Ms. Lipscomb's son. But the meeting was canceled for lack of a quorum after Ms.

Jones: Boycott leader continues fight in fifth decade of civil-rights activism From Page B1 "Some black people call him brusque, unpolished," said his longtime friend, the Rev. Fred Shuttlesworth. "But the truth isn't supposed to be polished." But the Rev. Mr. Jones has drawn the ire of whites and blacks alike, for which he makes no apology.

Others say he's at times unfocused and unrealistic, criticizing City Council members for failing to deliver what is beyond their control. "We need this, we need this, and if we don't give it to him, we're not representing our community," Cincinnati Vice Mayor Minette Cooper said. She said he calls for council to fire the police chief, having been told they have no such authority. "It's frustrating," she said. "He makes it real hard for But she quickly adds, "I think J.W.

brings a lot of messages that represent the community. I don't think they're going to jump off a bridge with him, but they'll follow him to that bridge and then decide." That's all he asks. Joined in the interview by a fellow boycott supporter, the Rev. Stephen Scott of First Recovery Christian Fellowship, he said the boycott's primary focus is reneged promises by city officials, and the fair distribution of public money into African-American neighborhoods.
