GREGG The Cincinnati Enquirer United Way leaders expect this year's campaign to fall $800,000 short if giving does not increase in the drive's final two weeks. Carol Aquino, spokeswoman for United Way Community Chest, said Wednesday that projections are based on comparing the status of employee campaigns with past performance. Last year, she said, United Way came within $15,000 of projected final campaign results. "We try to keep it conservative," she said. "This is as real as it can be, given all the things that can happen you have no control over." So far, $27,950,263 has been raised since the campaign kicked off in September.

That is 63.4 percent of the $44.1 million goal. The campaign ends Oct. 27. John E. Pepper, campaign chairman and president of Procter Gamble, said he expected to have 70 percent of the goal raised at this point.

He said volunteers will spend the final weeks of the campaign calling small- and medium-sized businesses that have not run employee campaigns before. Also, he said, volunteers will spend three hours Oct. 19 calling people who haven't given before, or those who didn't this year. "It is critical for any individual or organization considering a pledge to turn in a signed card now," he said. The United Way, which supports 114 area agencies, is trying to reverse a two-year decline in donations.

After a record year in 1991 with $43.4 million in donations, the past two vears have seen collections of $42.7 million and $42.1 million. The projected income of $43.3 million would put this year's campaign on par with 1991, Aquino said. Defense attorneys said Saen-' ger's patients accepted radiation "in an effort to be spared certain death from inoperable cancer" and people directing the project had no special constitutional duty to de-' scribe every risk just because they "In short, the due process clause (in the U.S. Constitution) is not a full disclosure act for public health-care facilities," Justice Department lawyers for Varon and Kessler said in their dismissal motion. "The Constitution of the United States is simply not violated when state-employed doctors perform experimental medical procedures on mentally competent, non-institutionalized, volunteer subjects." Moreover, the Justice Department argued, "The Bill of Rights protects individuals from unwarranted government interference with their ability to make choices for themselves. It does not protect individuals from their own decisions, no matter how ill-advised or ill-informed." At worst, the Justice Department said, the patients' claims amount to nothing more than an ordinary medical malpractice suit.
