City closer to center Eminent domain may net arts site BY JEFF HARRINGTON The Cincinnati Enquirer elose to buying just one of the six parcels needed for a downtown performing arts center, the city is ready to go to court to get the other five. Bill Plagge, real estate manager in the Cincinnati solicitor's real estate services division, said the city is at an impasse for acquiring 60 of the site at Seventh and Walnut streets and is prepared to file for eminent domain as soon as possible. Eminent domain is a government's right to take property for public use without the consent of the owner. A court determines the price paid to the owner. Earlier, the city reached a tentative agreement for buying one of the six parcels, which accounts for 40 of the site: a tract controlled by the Sandler-Kanter-Roth partnership. Details were not disclosed. Few options "I feel it's time now to file (for eminent domain in) those other five cases," Plagge said. "We're not even close with most of these owners. When we're so far apart in price, we don't have many options." He would only say the gap between asking prices and offers were in the hundreds of thousands of dollars. City council last month approved the use of eminent domain, if necessary. The only holdup for filing now is reaching an agreement between the city and state outlining payment responsibilities within the $93 million project, Plagge said. Without the agreement, money won't be available for filing cases and buying the Sandler-Kanter-Roth parcel, he said. $22.4 million pledged Mark McKillup of the city's economic development department said he aims to have such a pact in hand by the end of October. The city has pledged up to $22.4 million for site acquisition, but that budget includes costs of demolition, site preparation, staff time and relocation of existing businesses there. ON THE BLOCK: Throughout the spree of failures by savings and loans, Greater Cincinnati's reputation has remained unscathed. That shouldn't change next month, even though the area is represented in the Resolution Trust Corp.'s (RTC) first auction of high-priced properties taken back from S&Ls. For its Nov. 21 auction in Palm Springs, Calif., the RTC is placing 14 national properties on the block, including the Cottingham Retirement Center in Sharonville. The center, located near the intersection of 1-75 and 1-275, has been profitable. But it was taken over by the RTC after the failure of its owner, Kansas City-based Home Savings Association. The RTC was established by Congress in 1989 to manage and sell the assets of troubled thrifts. "(The word) auction just conjures up the impression of problems and fire sales. That's really not fair to the facility because it's not suffering in that manner," said James 0' Connell, senior vice president of CB Commercial Real Estate and local point man for auctioneer Kennedy-Wilson Inc. The center, built in 1984, includes 217 independent living and assisted-care units plus a 60-bed skilled nursing center. It was sold to Retirement Center Network Inc. in 1986 for $18.7 million. According to the RTC, it has an appraised value of $10.7 million, and next month's auction sets a minimum bid of $5.85 million. Also included in the auction are seven office buildings, a pair of retail sites, a hotel and country club in Palm Springs, and apartment buildings in Arizona. Buckles, one of four public and contract warehouse companies owned by The Verst Group, said clients already have committed to using all the new space.
