Feb. 9 Hall-Jordan BESS, Herbert BY WILLIAM A. WEATHERS The Cincinnati Enquirer Gary Lee Fausz, a lead singer with New Lime, a local band that had two top-10 hit songs locally in the late 1960s, died Tuesday during open-heart surgery at St. Elizabeth Medical Center South, Edgewood, Ky. Mr.

Fausz, of Fort Thomas, was 46. "Pops" Settles moved to Cincinnati more than 60 years ago, he and his wife opened their home to relatives moving to the city.

"They were kind of like surrogate parents to many members of our family," Mr. Settles' granddaughter, Trade McPherson, of Western Hills, said. "He helped put other family members on their feet when they moved to Cincinnati from South Carolina." In all, about 20 relatives stayed with the Settles family after moving from the South. Mr. Settles died Saturday of a heart attack at his Evanston home.

He was 89. He was devoted to his family and religion. "He was the one person who a lot of family members came to for advice and guidance," McPherson said. Mr. Settles was the superintendent of the Sunday school at Peace Baptist Church in Avondale from 1931 to 1989.

He was president of the senior choir at the church for more than 60 years, stepping down in 1986. He served on the church's trustee board more than 30 years as chairman, secretary and treasurer. The girls filed the complaint after investigators found 24 other children were mistreated including beatings, acts of sodomy and pornographic photo sessions at the county-run shelter for abused children in 1985 and 1986. Commissioners in September agreed to pay $725,000 to five of those children after a lawsuit filed in U.S. District Court alleged county policies led to their abuse and violated their rights. The other 19 never filed charges. The abuse probe prompted a purge in the welfare department and Allen House staff.

In Wednesday's settlement, the county denied all liability. The settlement is subject to Probate Court approval Monday. The case had been scheduled to go before the Ohio Supreme Court until the commission agreed to the settlement, Beth Silverman, one of the girls' attorneys, said. Death penalty sought in murder case GANNETT NEWS SERVICE COLUMBUS, Ohio The votes on school income issues in Tuesday's election gave Franklin B. Walter, superintendent of Publiq Instruction, a "reason to celebrate." Four of 13 ballot issues across the state were approved.

But the 30 approval rate is an improvement over the 20 approval rate in November, the first election in which school districts were allowed to ask voters for higher personal income taxes. Walter particularly was pleased with approval of Goshen's income tax issue. "In communities such as Goshen, where voters had not approved an operating levy in more than a decade, Tuesday's results are indeed reason to celebrate," Walter said Wednesday. He visited the district two weeks before the election. The four issues approved Tuesday had been defeated in November, when voters rejected 65 of the 82 school income tax issues in the general election.

Voters also approved higher income taxes for Canal Winchester schools in Franklin County, New London schools in Huron County and Paulding schools in Paulding County. The Hamilton County grand jury Wednesday indicted Christopher Lamont Maupin, 22, on one count of aggravated murder and two counts of aggravated robbery in the death of Abhay D. Sharma, 41. Maupin was arrested Dec. 17. Sharma was killed as he left the Woodlawn Pony Convent, and Mary Jean Barrett, 73, of the 2400 block of Ferguson Road.

Newman is accused of driving through a stop sign and driving under the influence of alcohol at the time of the Dec. 3 accident. Hubert E. Connolly, 22, of the 1600 block of Queen City Avenue. Connolly is charged with one count of murder in the Jan.
