Page 8 THE GAZETTE, EMPORIA, KANSAS. Topeka: WINNER Anita Bryant is shown at a press conference in Miami Beach, Tuesday night after her group, Save Our Children won its battle for the repeal of a Dade County homosexual rights law. (AP Wirepholo) Rights Law Repealed. Homosexuals React to Miami Defeat By the Associ.ired Prcis What supposed to bu a victory celebration turned into a wake in Miami. A mournful candlelight inarch was held in San Francisco.

In New York, the gay bars were somber. Homosexuals and others favoring equal treatment were dismayed by Tuesday night's election results from Dade County, and derided thuse who had voted to repeal that county's homosexual rights law. "They hate us for our virtues, not our vices." said ard Mallovich, who gained national attention in when he was discharged from the Air Force for acknowledging his homosexuality. "It's going to take a lot of love to turn this around because they don't know to love." Sarah Compton, who also was at the Fontainebleau Hotel in Miami Beach, said "Homosex- uality isn't a sin. Discrimination against another person for sexual reasons is the real sin." She said she was heterosexual.

Instead of celebrating the hoped-for victory, the 300 people sang civil rights songs and listened to speeches urging them to keep fighting. Meanwhile, Anita Bryant, who led the repeal effort, "danced a jig," said Mike Thompson, of Save Our Children. Miss Bryant, who promised a national crusade against homosexuality, had organized Save Our Children, which charged that the ordinance would allow homosexuals to recruit children and serve as role models. In San Francisco, a candlelight vigil and march was held on gay-oriented Castro Street, and the marchers wore black arm bands. But the city's large and politically active homosexual com- munity an estimated in the population of CGO.OOO prepared for the next battle.

"We're not going to give up," said David Goodstein, publisher of the nation's largest gay newspaper, The Advocate. "I sort of look at it like a war metaphor. We had an army of recruits. Now, we have an army of San Francisco's homosexual community, ridiculed in an anti-gay commercial in Dade County, had poured cash and political talent into the anli-re- peal effort. They held benefits, sold hundreds of T-shirts with anti-Bryant slogans and boycotted Florida orange juice products.

Miss Bryant does television commercials for the Florida citrus industry. Between 500 and 1,000 supporters of civil rights for homosexuals marched through New York's Greenwich Village early today, apparently demonstrating against the defeat of the or- dinance. Police said the marchers were peaceful but loud. They went from one gay bar to another, picking up cohorts for the demonstration. Morly Manford, head of the National Gay Task Force, said in New York that the group would continue its "fight for human liberties and civil rights." He called the vote "a short-run defeat which highlights the absurdity of placing a minority's civil rights on public referendum." (AP) A case testing the authority of the Kansas Corporation Commission to regulate sales of natural gas to five Kansas municipalities was taken under consideration Tuesday by the Kansas Supreme Court. The case was appealed by Cities Service Gas Co. from the Osage County District Court. The lower court upheld the jurisdiction of the KCC to regulate sales of gas by the firm to the municipalities of lola, Garnett, Neodesha, Osage City and Chanutc. The Corporation Commission assumed jurisdiction after a complaint was filed by the cities.

The municipalities said Cities Service sales to them were'not then subject to regulation by either federal or state agencies. They contended that contracts with Cities Service were submitted for acceptance or rejection and were not negotiated, with the rate left solely to Cities Service. Cities Service argued KCC regulation over these sales would constitute an undue burden on interstate commerce in violation of the U.S. Constitution. The natural gas firm also argued that the sales are not those made by a public utility within the meaning of the Kan- law.

Another argument advanced by Cities Service that the findings' of "need" by the Corporation Commission in proposing to assume jurisdiction are not supported by or arc completely contrary to the evidence. In seeking Corporation Commission regulation, the cities pointed to rate increases experienced in recent years. Neodesha said it had increases of 7 per cent in 1961, 5 per cent in 1963, 12 per cent in 1969, and 15 per cent in 1U72. Chanutc said it had increases of 'I per cent in 1958, 7 per cent each in 1959 and 1961, 8 per cent in both 19C3 and 1963, 3 per cent in 1970 and 17 per cent in 1972. New House Here Sold Mr.
