PHAROS-TRIRl'MH LMASSPORT, INDIANA, THURSDAY. FKBRUARY 4. 1982 PACE 3 Rozzi Continued From Page 1 Valentine said FBI agents observed Rozzi visiting Ball's house on Oct. 2, 9, 16, 23 and 30. 1979.

Valentine said Rozzi also was seen at Ball's house on Nov. 30. They were all Tuesday visits. FBI agents who were watching the house said Rozzi's was in Ball's house for periods ranging from 50 minutes to nearly an hour and a half, Valentine testified. The FBI surveillance teams said Rozzi drove a city-owned police car to Ball's house on all six visits, Valentine said.

Valentine said Rozzi backed the city car car up to a privacy fence in the rear of the house. The FBI agent said a gate then was opened, allowing Rozzi to drive onto Ball's property. The gate then was closed. Valentine said FBI agents shot two photographs of Rozzi driving to Ball's house. Rozzi's attorney later established the photos do not show Rozzi entering Ball's property.

Valentine said he interviewed Ball in November of 1980. He quoted Ball as saying she first paid Rozzi "$1,000 and then S200 a week after that." Ball was quoted as saying the payments all were made "in cash on Tuesdays." The surveillance also involved use of a "pen register" an electronic device used to tap telephones. The device records telephone numbers that are called and the lengths of the conversations. Valentine said. Valentine said wiretapping was approved Dec.

16. 1978. by a federal magistrate in South Bend. Valentine said the FBI tapped Ball's phone and a private line at Logansport police headquarters. The wiretap was approved for 30 days and was installed secretly at General Telephone headquarters in Logansport.

Valentine, responding to questions from Leeman. said the wiretap did not reveal any calls made to Ball from the police station: It also revealed no calls from Ball to police. Valentine also quoted Ball as saying Rozzi had warned her of the wiretaps. The FBI agent said Rozzi visited Ball twice in December, 1979.. when she was hospitalized.

Valentine quoted Ball as saying Rozzi "told her that her telephone was being tapped by the FBI and that the police department line also was being tapped." Ball is scheduled to testify later in the trial. The prosecutor, in opening statements to the jury, said he would prove Rozzi took payoffs to allow Ball to stay in business. Kragh alleged Rozzi began taking money late in 1979, when his term as police chief was near its end. Leeman, in opening remarks, said Sherry Ball decided to use Rozzi as a "scapegoat when she got in trouble." Leerrian said Rozzi was trying to do his job as police chief on the occasions he did contact Ball. Leeman also characterized Rozzi as a hard-working, dedicated public servant.

He pointed out that Rozzi worked two jobs, even while serving as police chief. Leeman said Rozzi worked for the police department and maintained a part-time job as a night janitor. Leeman criticized the prosecutor's treatment of Ball, who entered into a plea-bargain agreement after being arrested. She agreed to testify in return for a suspended prison sentence. Leeman also was critical, in his opening remarks, of agent Valentine.

He said Valentine knew prostitution existed in Logansport but took no action for several years. Employment Closings Held Up INDIANAPOLIS (UPI) Plans to close 11 Indiana Employment Security Division offices and cut off job placement assistance at 12 others were delayed pending restoration of funds from Congress, said Gov. Robert D. Orr. Legislation which would restore about $210 million of the original $263 million cut from the national employment security system in December passed the labor subcommittee of the House Appropriations Committee.

The legislation now must be approved by the full committee. "The Congress has apparently realized the oversight they made in removing the funding for the employment service offices," Orr said Wednesday "Due to significant constituent pressure on the Congress and support from the Reagan administra- it seems certain that the funds will be restored, "he said. Her office received more than 265 calls from residents requesting the blocks of cheese the first day. "We have had to turn people away," she said, "and the Salvation Army, Eel Township, Harrison Township and county welfare offices have also been turning people away."
