January 27 of combining in an international trust, 12 corporations Accused in the electric light bulb industry tonight stood charged, in a complaint filed in Federal Court, with conspiracy to restrain trade and commerce. The complaint, filed by Acting Smith, alleges violation United States Attorney Willagher: man Anti-Trust Act, the Clayton Act, and the. Wilson Tariff Act.

A Named in the complaint were General Electric Company, International General Electric Company, Westinghouse Electric and Manufacturing Company, Corning Glass Works, American Blank Company, Empire Machine Company, N. V. Phillips' Gloelampenfabricken, Consolidated Electric Lamp Company, Hygrade Sylvania Corporation; Ken-Rad Tube and Company, Chicago Miniature Lamp Works, and Tung-Sol Lamp Works, Inc. The defendants were accused of having gained control of the light bulb industry through unlawful use of patent licensing agreements and agency contracts. Of the products involved, radio tubes and searchlight lamps are vital to national defense.

It also was alleged in the complaint that General Electric and Westinghouse, through their position in the industry, have been able to control and suppress competition of independent lamp manufacturers. In order to restore competition to the industry, the government seeks cancellation of certain patent licensing agreements and reorganiof some of the defendants business organizations. A little good combing length fine territory wool in origipal bags was sold at $1 to $1.02, scoured basis. Combing three-eights blood terriwool was quoted at 85 to 88 cents, tory scoured basis, with demand very limited. Graded combing bright three-eighths and -blood fleece wools were held at quarter 44 to 45 cents, in the grease, for each but the few bids were under this grade.

Criminal Action Is Dropped Against BMI, Radio Chains; ASCAP Suit To Be Pushed Washington, January 27-(INS) -The Justice Department today, announced withdrawal of criminal proceedings against Broadcast Music, the National Broadcasting Company, and the Columbia Broadcasting System in a proposed antitrust prosecution, Broadcast Music, the department disclosed, signed a consent decree in the Federal District Court for the Eastern District of Wisconsin, agreeing to refrain from violations of the Sherman antitrust law in its licensing of music. Attorney General Robert Jackson announced one month ago intention to file antitrust cases, charging criminal violations, against BMI, NBC, CBS, and the American Society of Composers, Authors, and Publishers.

There is "no change," the department said, in its announced intention to proceed promptly with criminal proceedings against ASCAP, noting that negotiations looking toward a settlement of the ASCAP case had "ended abruptly" in late December. The decree will not take effect, it was announced, until similar restraints have been imposed upon ASCAP, in opposition to which BMI was formed, either through a decree or litigation. IRON AND STEEL New York, January 27-(AP)-Steel operations this week will advance to 97.1 per cent of capacity from the revised rate of 96.5 per cent last week, the American Iron and Steel Institute said today. The Institute made its weekly estimate on the new basis of theoretical capacity at the end of 1940. This was computed Bessemer at 84,148,000 tons of open hearth, and electric furnace steel, compared with 81,614,000 tons at the end of 1939, upon which previous estimates were based. Operations a month ago were 95.9 per cent of capacity and a year ago 77.3.

BMI was organized shortly before the radio chains and ASCAP reached a stalemate in their negotiations for a new contract to replace one which expired January 1. Since that time only BMI music has been used on the networks. Postponement of the decree's effect was for the purpose of insuring that BMI would not meantime be placed in an unfair competitive disadvantage, the department said. Terms of the decree provide that all BMI compositions must be offered to all users of the same class on equal terms and conditions; that motion picture exhibitors, restaurants, hotels, radio stations, and all commercial users of BMI music be able to obtain right to perform any compositions desired without being compeled to accept the entire BMI music catalog.
