Deaths, Funerals WASHINGTON 111 Unlrn attorneys asked the U. S. Court of Appeals Friday to throw out a Federal arbitration ruling that would eliminate thousands of railroad jobs. Attorneys for four rail unions said the law creating the arbitration board was unconstitutional, and that the board exceeded its authority under the law. "THE QUESTION is not how the railroads are to run their business," said union attorney Max Malan, "but whether the employees have some voice in setting working conditions." The unions claim that the eventual elimination of some 50,000 Jobs mostly firemen would jeopardize safety on the trains.

"It was the unions that had to fight for safety laws against the opposition of the carriers," Mr. Malan told the three-judge Court of Appeals. He argued that the arbitration board should have incorporated into its findings some of the tentative agreements reached in previous negotiations, but that it ignored them completely. He had contracted the disease In the Orient and had been at Carrville since 1945, but the malady was arrested and he visited Cincinnati as late as 1956. As a Cincinnati youth Mr. Ness had two distinctions: He was for a time a coachman for the late L.

B. Harrison and later, working for a roofer, he tumbled from a St. Bernard Procter Gamble roof where slate was being laid. Injuries didn't prevent his entering the Spanish-American War. He served a hitch in the Fifth Infantry, another in the cavalry and a third In the infantry again.

He saw service In the Philippine Insurrection. In 1901 Mr. Ness was orderly for William Howard Taft, then commissioner in the Philippines, the islands where Mr. Ness made his home most of the time when he wasn't roaming the world. In World War I he was In the merchant marine and helped ferry troops to France.

Between World Wars I and II he made several 'round-the-world merchant marine voyages. Captured by the Japanese in World War he was a prisoner for four years. Liberated by U. S. Rangers, he landed back in the States on his birthday, May 9, 1945, weighing in at 79 pounds on re-entry.

Surviving him are a brother, August Ness, 1138 Race and a number of Cincinnati nieces and nephews. Mrs. Esther Richrn Services for Mrs. Esther O. Rlchen, 69, who died on Wednesday at a Madeira nursing home, will be at 9:30 a.

m. today at the Mon-fort Heights Community Methodist Church. Her home was at 5456 Phlllorett Monfort Heights. For many years Mrs. Richen was pianist and organist at the Columbia M.

E. Church and the Monfort Heights Community Methodist Church. She taught piano In Linwood and Monfort Heights. She was a member of Ohio Chapter 218, Order of Eastern Star. Survivors include two daughters, Mrs.

Paul Hughes, Mt. Healthy, and Mrs. Bernard Hicks, Mason; one son, Charles L. Richen Monfort Heights; two sisters, Mrs. Matilda Bogart, Cincinnati, and Mrs.

Margaret Johnson, Ft. Myers, and five grandchildren. drove Christopher Mrs. Grace Mlddlehoek Christopher, 77, formerly of Terrace Park, died Tuesday in Evanston, 111., friends in Cincinnati learned Friday. Services and burial were at Evanston Thursday.

A native of Michigan, Mrs. Christopher was a graduate of Evanston Hospital School of Nursing and served overseas with the Army Nurse Corps in World War I. She was the widow of Arthur C. Christopher, Cin 1 a i. Surviving her are one stepdaughter and two stepsons.

She was a former member of the Altar Guild of St. Thomas Church, Terrace Park. Services for a Cinclnnati-an whose home was the world, rather than just the Queen City, from the onset of the Spanish-American War will be at 11 a. m. today at the Staley Funeral Home, Deer Park, with burial in Arlington Memorial Gardens.

George A. Ness, 89, died Boy, 6, Killed On Leaving Seliool Bus A Butler County first grader was struck and killed Friday by the school bus he had been riding only moments earlier. The State Highway Patrol and Butler County deputies Identified the victim as David Stamper, six, son of Mr. and Mrs. Glenn Stamper, 5228 Maud-Hughes about 10 miles east of Hamilton.

He died of severe head injuries suffered beneath the left front wheel of the bus. Dr. Garret J. Boone, Butler County coroner, said. The accident occurred In front of a home adjoining that of the Stampers at 5172 Maud-Hughes Rd.

The bus driver, Alfred W. Heuman, 31, 5944 LeSourds-vllle-West Chester told police that he stopped to let a girl off at that address but did not see the boy get off. Loyola Honors President Of University Rev. Paul L. O'Connor to get degree Very Rev.
