bliss it seeffis is not all that it is made to appear rom the number of divorce suits filed in the courts one would suppose that the idea of happiness in marriage was a mockery Hardly a day passes but that some one comes out with a long bill of complaint against what was intended to be a better half but by some freax of nature has developed into the worst possible half one could have chosen The City Court yesterday got one of these suiis It was filed by Martha Thornly against Jesse Thornly She says that site was married to her hus band in December 1872 rom' that union five children all living now with their mother were born She and her husband lived together in peace and harmony and good will until December when he began a svstem of brutal and inhuman treatment toward her and has kept it up until the present time frequently beating choking and cursing her and on several occasions during that time threatened to kill her such acts of cruelty making her life a burden and causing her to live in daily appre hension of bodily harm On the 10th of December she says he grossly mistreated her beating am choking her and pulling her hair aid finally threw a stick of cord wood at her knocking her against the wall ust a few days since says the bill he threat ened to kill her and burn her and the house together To carry out this tin cat he poured a large amount cf kerosenst oil on the floor and would have burned the house up had he not been prevented She goes further and says th at since their marriage he has become an habitual drunkard neglecting his family and fail ing to support them On several occa si7ns he left his home and cohabited with other women and confessed it to hia wife when he returned The prayer of the bill sets forth that as he is a shiftless and dissolute chars setor lie is not a fit person to have con trol of the little children and the wife asks that thev be given to her charge and that she be allowed to resume her maiden name and if she should desire be permitted to marry again Joseph Lewis an engineer filed a rather novel damage suit against the Alabama Great Southern Lewis was employed by the road to run an engine attached to a construction train One day the train struck an ox on the track and the pilot or cow catcher was crushed and broken and the engine thrown from the track Honestly believing bis life to be in danger he sprang off the engine an: the fall broke bis leg at the ankle Lewis wantsS20C00 as damages for thw injury claiming that the accident wa: due to the negligence of the road in not keeping the engine in repair the pilot having three ribs out and four other? and one of the back braces broken thm rendering it so weak that when the ox was struck it gave way and wrecked the train Lighter and Lighter filed a suit against Hawkins Tipton fee 8U04(80 damages for a breach of ar ngr ement entered into by them Tb farmer parties made a contract with Hawkins Tipton to lay the brick in the Xorth sewer at the rate of $275 per thousand The contract was mart August 17 They claim that on the 23! of September when they had laid about 700000 brick and about 3300000 wen yet to be laid according to the plam and specifications made by the city en gineer that Hawkins Tipton oidered them to stop work and when they pro tested persisted in the ordei and compelled them to qub in the faceof the concract Besides the above suits several assumpsits were filed CIRCUIT COURT The Circuit Court finally disposed cf the suit of Beard against Horton giving the plaintiffs verdict fcr Smithfield stock continued to sell sheds aud stables at West End Thirty negro convicts passed through the city yesterday on their way to the Pratt Mines They were in charge cf Guard Musgrove A Watchman Saves the JLives of Tv Young Ladies Jno McCrary one of the flagmen em ployed by the Louisville A Nashvil Railroad Company to guard the Twen tieth street crossing met with what wil probably prove a fatal accident while heroically discharging his duties yester day afternoon An unruly horse at tached to a single buggy which was oc cupied by two young ladies became uns manageable while going over the cross ing and ran upon one of the tracks just in advance of a fast approaching train The young ladies became frightened and dropped the lines and began screaming The screams attracted! he attention of McCrary and he sprang to the bead and backed him off the track just in time to avert a hor rible accident He was not quick enough in getting oil himself how ever and the train consisting cf a Louisville A Nashvillejswitcb engine and a number of empty box ears struck him with full force The train was stopped as quickly as possible and the injured man was picked up insensible placed in a cab and sent home A physician was summoned and visited the wounded man at his residence ou the South Highlands After a careful examination of his injuries which were internal the doctor expressed little hope of tire recovery He is a dangerously wounded by an unknown negro By direction cf the Board of Managers Secretary rlatshek of the Alabama So ciety for the Prevention of Cruelty to Animals has ordered his men to prose cute necessity 1 both these th? euugs STAR Made Against a irm of Well Known Bailroad Contractors Last September Allen Norwood contractors on the Birmingham Mineral Railroad fonnd themselves short of hands Mr Norwood came to the city and finding the prison full of negroes decided upon a novel method of recruit ing his camp He paid the flues of some forty of the prisoners who were serving sentences for larious violations of the citv laws The prisoners longed for the pure air of the country where they could feast their eyes on the beauties of nature and listen to the carol of the birds They readily agreed to the change and vowed they would woik faithfully until the amount er their fines were paid They were to be allowed one dollar per day and Messrs Allen Norwood agreed to give them regular work at that price if they wished to avoid the temptations of the city after serving out their terms A few of them had no regard for their obligations and succeeded in making their escape soon after reaching the camp Yesterday twelve of the ex prisoners arrived in the city and immediately went in search of a lawyer They had a story to tell and they told it in language more forcible than elegant They claim that they worked out the amount of their fines as agreed but when they attempted re leave the camp they were stopped by armed guards Thev say they were forced to wrk nearly three months and that Messrs alien Norwood refused to pay them anvthiug for this labor They were in dignant and wanted some law to soothe their outraged feelings They employed attorneys and yesterday twelve suits for partisan whose retention in office here was unfair to class cf Democrats in the South who struggled so manfully for the suc cess of the Democracy and who now demand the placing jn retirement that clas of Republicans who rendered them selves obnoxious by their oppression and unfair manipulation of The article makes various charges of offensively partisan acts and said the matter wonld be placed before Southern Democrats in An Age reporter called on Postmaster Throckmorton yesterday and learned that he also bad received a copy of the marked paper Yes me postmaster said there was a John Day iu The fair continues to draw in spite of the bad weather The crowd last night was large enthusiastic and liberal and the receipts were very grati fying The german at the Wilson House cut down the attendance slightly but the crowd as almost as large as en Thursday night Justice election was one of the most attractive' features and several hundred votes wsre polled for the differ ent candidates for sheriff The election will be continued every night during the fair and its result will show who is the most popular candidate for sheriff The cost of voting for the most popular captain was reduced to 10 cents and hundreds of votes were cast during the evening Mrs Samuel Ullman and her assist ants at the summer booth who are among the hardest workers introduced a new election scheme last night which at once became popular a diamond pin will he voted to the mist popular lady at the fair A great many votes were cast last night The reslauraut was well patronized last night and the receipts were unusual ly large About 9:30 ihe Kinghts of Pythias in full uniform marched in and took supper at the restaurant The bill of fare last night was an excellent one Several valuable
