confessed three times to murdering i and beheading Stephanie Dubay. Defense lawyer Timothy Barkovic had tactics he figured just might get Rodriguez acquitted. Rodriguez's demonic split personality "Jim" was in control the day Dubay was murdered and mutilated, Barkovic a Macomb County jury in June, playing to the packed courtroom, including reporters and TV cameras. And Barkovic appeared determined to shock the jury by showing a gruesome video of the slaughter scene, trying to shore up the insanity defense. Rodriguez was convicted.

But that hasn't changed Barkovic's freewheeling, theatrical style. In a series of high-profile cases, he has earned a growing reputation in Macomb County for flamboyance. When a 20-year-old rape and abduction victim said her attacker had what looked like a cat tattooed on his right upper arm, Barkovic, defending John Belcher, 39, of Warren, subpoenaed a parolee who had briefly been suspected of the crime and who had a tattoo of a lion on his arm. Belcher, 39, was convicted. Barkovic brought in a West Coast memory and perception specialist to show that race, stress and the passage of time influenced witnesses who testified about the beating death of black teenager Chuckie Gibson during a fight with white teens in Roseville.

The jury convicted Barkovic's client, John Whitman, 19, of felonious assault, a lesser crime than the open murder that was charged. Some courthouse observers say Barkovic's sometimes implausible arguments actually undercut his cause. Others say he's creative and zealous. He says he is doing his job the way he does it best. "Unless you can approach a case with a lot of enthusiasm, you shouldn't do it," Barkovic, 39, said recently while tugging on his collar-length light brown hair, a habit he's had since boyhood.

"I like a challenge. Otherwise I'd plead more cases." Assistant Macomb County Prosecutor Gerald Warner, who tried the Gibson case, said: "I think good trial attorneys have to be theatrical. She added: "Sometimes he looks like he's going to explode. I tell him to slow down." Barkovic graduated in 1975 from Eastern Michigan University. He describes himself as an average law stu-. dent at the Detroit College of Law, graduating in 1979. He still lives in the Warren home his parents bought when he was 8.

He and his wife, Shaqe, have a 2-year-old daughter and a child on the way. Court-appointed felonies such as the Rodriguez and Belcher cases don't make up his whole practice. Last year, he earned more than $100,000 in a lawsuit over a traffic death. He said an early ambition was to be a geologist. Maybe that's why, in pursuing a case, he tries to leave no stone unturned.
