THE FRESNO BEE S-A Friday, August 7, 1964 Judge Raps US 'Miscarriage' In Robbery Case SACRAMENTO -- UPI -A -A federal judge lambasted the Uhjted States Attorney's Office Office for "miscarriage of justice" justice" in the handling of three accused bank robbers who killed a highway patrolman. "They shoot down an officer officer in a cold blooded murder and keep firing at him until they blow his body clear across the highway," the judge said yesterday, "and then the United States attorney attorney doesn't want to prosecute the bank robbery." Judge Sherrill Halbert made the statement in rejecting a petition by the US Attorney's Office to dismiss informations against the three, exconvicts for a $44,000 bank robbery here last November. They were sentenced to life imprisonment for killing Patrolman Patrolman Glenn Carlson near to o d u c e r s he Truckee, N e v a d a when Carlson tried to stop their getaway. The excon- victs, Roger Mealman, Robert Burns and Clifford Toycen, will be eligible for parole seven years. Judge Halbert told an assistant assistant US attorney, "I can't make you prosecute but I certainly can keep myself from being a party to what consider a miscarriage of justice." Most of the bank money was recovered.
