Hazlewood, who presided over the 1985 trial, reviewed the trial transcript and said the witness identified Avery as her assailant and denied scratching or biting Avery. The judge concluded that simply because the fingernail scrapings were not from Avery or the victim did not mean that he did not commit the crime.
