Order Stays Proceedings In Will Circuit Court Judge Halford 1. Srreeter has signed an order staying proceedings in the execution execution of a will of a former Port Huron resident, pending a hearing hearing May 12. Donald C. Lester has tiled suit in the estate of Marjorie . Lester, who died Oct. 16. IMS in Port Huron. Defendants are iliildren of Marjorie Lester by a previous marriage. They are .lames M. Kliemann, Richmond, Richard L. Kliemann, Mt. Clemens, Clemens, Joan S. Berk. Port Huron, Huron, and James M. Kliemann as the executor of the deceased's estate. Plaintiff claims that he a n d the deceased on Oct. III. 1958, had a w ill drafted in which they agreed the entire estate would go to either surviving party, and the remainder to be divided among the children Plaintiff claims thai will contained contained a clause that the 19.jS document document would not be changed without mutual consent, and that he never consented in writing or otherwise to changing pro- pro- isions of the document. He alleges alleges that Marjorie Lester signed signed a handwritten paper on Oct 15, 1968, or the day before she died, that is purported to be her last will and testament. Plaintiff alleges thai i he IMS paper was admitted to probate, and it disinherited him. He also claims that on Oct. 24, 1958, a quit claim deed was executed to his wife giving her property at 2248 Woodstock Drive, and that Mrs. Lester executed a quit claim deed to the property on Sept. 10, 1964. Plamtiff asks the court to stay proceedings including disposition of property, to declare the 1958 will is irrevocable, that the 196S paper is a nullity, and to grant other relief.
