LOOIBVILLB, Ky., Oot. S3.—Saturday afternoon Flnley Smith and John Howard, Howard, the latter a 10-year-old brother of Willis Howard, were In town, where the father of the Howard brothers live. John Howard was walking along the street and Finley Smith was In the door In the Cumberlaln house when they saw each other. Howard pulled his pistol and young Smith seized, a Winchester rifle which waa near him and both began to shoot. One of Smith's bullets grazed Howard's temple and the shock knocked him down. While he lay there, stunned for tbe moment, moment, Smith left, as did Howard a few minutes later. This shooting occurred about 5 o'clock Saturday afternoon. John Howard left town and when the news reached Willis Howard, within an hour or two, that his brother bad come near being killed by a member of the law and order party, be vowed vengeance. Sunday afternoon a reliable messenger of tbe law and order party brought intelligence intelligence that the outlaw had sent word to all his men to come well armed to a reu- de/.voua n few miles from the county seat and that a large crowd was gathered at bis summons. Tbe attack was expected at any time wben the gentleman left Harlan Harlan Court Heuse, the seat of Justice of Harlan county, which IB now converted into a citadel by the law and order party, Is thirty five miles from Plneville, which is the nearest railroad point.
