OBBDmotig THtJRSDAX i MOTHERS DESPAIR Forcibly Deprived of Her Littlfr Son MY BABY OH MY BABYI1 Painful Scene Enacted Judge Lawlers Court Yesterday In A painful scene occurred in Judge Lawlers court yesterday growing out or the removal of a child from Us mothers mothers custody On Saturday last a writ of habeas corpus was granted to David Eeulein commanding Mrs Anna Clarke to produce produce her son Charles Henry Clarke aged 4 years in court The petition for the writ stated that Benlein and bis wiie Kate were the lawful guardians of the child and that be bad been forcibly and illegally removed from their custody by Mrs Clarke and Rebecca Rebecca Hernnger hex mother In a suit filed on the same dsy Mrs Clarke asserted that she had consented to the adoption of her son by the Reuleins some months go through fe ir of personal personal violence at the bands of her husband husband James P Clarke a brother of Mrs Bettlein When tbe case was called yesterday Attorney M Cooney representing the mother aseed for a continuance bas ing bis request on a physicians certificate certificate that his client was in such a delicate delicate condition that It would be danger - bus tor her ta leave borne or to be subjected to any undue excitement Judge Lawler however denied the request request and Mr Cooney dispatched a messenger for his client and had her brought intd court Testimony was taken which shofced that while the Benleins had legally adopted the child WfWjr teparated fifteen months ago he had ever since conlinuedln the nstody of his mother and that she bad provided for his sap - port An attempt was made by Mrs Clarkes attorney to show that the adoption paper introduced in evidence was invalid Henry L Kowalsky Reuleme attorney objected snd Jndge Lawler sustained the objection He further denied a motion to dismiss the writ and despite the protest of Mr Cooney decided that the child should be returned to its guardians Tbe bailiff of the court attempted to enforce this order but the mother clung to her child with a strength bom ot desperation and resisted every effort effort to take him from her So heart - sending were her cnes tnat the bailiff at length desisted Another Deputy bherinT was sent for and while the Court waited the mother strained the child to her heart and sobbed outn her grief such disconnected sentences as Tbey shall not take him front me lr I will go to jail firstl Heis my baby isunered for him and now tbey would steal him from me I The child also sooted and there were few dry eyes in the courtroom W hen help arrnved another vain at tempt was made to wrench the boyH irom us mowera arms ana again tne officers bad to assist Judge Lawler tried to induce Mrs Clarke to give np the child peaceably She related however and again the Deputy Sheriffs Sheriffs obeying the Judges order as be hastily left tbe oartroom seized the distracted woman and while two of them held her tightly a third person standing near seized the screaming boy and bore him from the room My baby oh my baby I shrieked Mrs Clarke hystencslly as she fell from the officers arms to the floor Again and again the heartrending cry was uttered but it fell on ears that were deaf to her supplications for folly ten minutes the poor mother refuse refuse to be pacified but soubed and moaned as hough ber heart was broken Those about the courtroom withdrew snd left ber alone with ber friends and ber grief the wss finally sufficiently calmed - to permit ber parents to lead her from the courtroom courtroom and started toward borne Further proceedings will immediately immediately be instituted by her attorney to recover the possession of the child
