EXECUTION SET FOR ABDUCTOR Missouri Supreme Court Upholds McGee Sentence, First of the Kind JEFFERSON CITY, Mo., March 30.—UP)—The nation's first death sentence, for kidnaping was upheld by the Missouri supreme court today when it denied the appeal of Walter H. McGee and set May 10 as his execution day. McGee, leader of a gang which kidnaped Miss Mary McElroy for $30,000" ransom nearly two years ago, alternately raged and wept in his Kansas City jail cell when told of the decision. Miss McElroy, brunette 26-year- old daughter of H. F. McElroy, city manager of Kansas City, said she "would rather not comment at this time," but her sympathy for McGee and his brother, Georgqe, serving a life term in connection with the kidnaping-, has been expressed many times. The McGees, although they crossed a state line with their fair prisoner, were tried under Missouri statute, which curries the death penalty for kidnaping. Judge H. F. McElroy, father of the victim, also declined to comment on the court's decision. "What did they do, bring the rope back to me?" asked McGee in the Jackson county jail, "I'll take it to the supreme court." Miss McElroy, kidnaped from her home May 27, 1033, and kept chained in the cellar of a house near Shawnce, Kas., for 30 hours until her father paid $30,000— one-half of the amount originally demanded—has been nervous anci distraught with worry over the prosecution of her abductors. She disappeared from her home the night of Feb. 10 and was intercepted the next, day at Normal, 111., on « Chicago-bound bus. She attributed her impulsive flight to her feeling of personal responsibility in the death sentence of McGee. McGee's brother, George, who guarded Miss McElroy, is serving life in the Missouri penitentiary. Clarence Click, who lived in the house where Miss McElroy was held, is serving an eight-year sentence. Clarence Stevens, who allegedly aided Walter McGee in the actual abduction and collection of ransom, has not been apprehended. I
