Scales Of Justice Tip Toward Liberals WASHINGTON (UPI)-When Thurgood Marshal takes his seat at the junior end of the Supreme Court bench Oct. 2, the court's philosophical scale will tip toward the liberal side. Marshall, confirmed by the Senate Wednesday as the first Negro Supreme Court justice, is expected to bolster the liberal bloc headed by • Chief Justice Earl Warren. Justice Tom C. Clark, whom Marshall succeeds, was considered a mild conservative. The Wairen group usually includes Justices Hugo L. Black, William 0. Douglas. William J. Brennan Jr., and Abe Fortas. But Black lately has indicated he feels the civil rights movement needs a brake. He has voted in several cases with the conservative wing composed of Justices John Marshall Harlan, Potter Stewart. Byron R. White and Clark. Marshall's arrival will give the Warren bloc a majority regardless of which way Clark goes. Marshall himself has said he is not attached to any legal school of thought, but adds "I am not a conservative." In the field of criminal law, however, he may be inclined to vote for preservation of government authority. As U.S. Solicitor General, he urged the Supreme Court to give the police more leeway for searching private premises in criminal investigations. After" his confirmation on a 69-11 roll call, the 59-year-old Marshall said he was "greatly honored by the appointment and 'its confirmation." Southern Senators who opposed the former civil rights lawyer's nomination to the High Court talked against his aj>- )ointment for hours, terming lim a "judicial activist" and a "constitutional iconoclast" who could not discharge his new duties with the "cold neutrality of an impartial judge."
