Former Chief Justice Henry Gallagher Dies WASECA, Minn. (AP)--Henry M. Gallagher, former chief justice of the Minnesota Supreme Court died at his home in Waseca early today. He was 79. Justice Gallagher suffered a series of strokes, the first in late 1963, and had been bedridden about a year. He was appointed chief justice of the Supreme Court by Gov. Elmer N. Benson in 1937 and resigned in the early 1940s during his first elected term. He was a brother of Frank T. Gallagher, retired Supreme Court associate justice now serving as commissioner with the high court. Gallagher was a native of Waseca County, and was graduated from Creighton University at Omaha in 1910. He practiced law in Waseca, served as municipal judge, was twice elected county attorney and was a member of the Minnesota State Industrial commission in the early 30s before being appointed to the he Supreme Court. Surviving are his widow, a Mrs. James Gahler of daughter, Wascca, and his brother, Frank. Funeral services will be at 10 a.m. Tuesday at Sacred Heart Catholic Church in Waseca
