P.A. Judge Delays Utility Ruling Meeting on Dissolution Will Will Be Postponed WILMINGTON, June 27. Counsel for the North American Company, utility fighting for permission to dissolve a subsidiary, argued in Federal court here today that theSecurities and Exchange Commission should not set itself up 'in the role of a dictator." "It cannot be too strongly stressed," said S. Pearce Browning. chief counsel for North American, "that the public utility act gives the commission absolutely no power to require any holding company to continue its own existence." The argument was on an injunction asked by the SEC to restrain North American from voting its per cent control for dissolu tion of an intermediate holding company, the North American Lieht Power Company.

Judge John P. Nields reserved decision on the SEC plea for the restraining order. At his request, the opposing attorneys agreed to an adjournment of the light and power company's stockholders' meeting scheduled here for next Monday. A new meeting was set for July 21. UP) The New York State Electric Gas Corporation today awarded to the Equitable Life Assurance Society of the United States $35,393,000 first mortgage 31 per cent bonds, and thereby partially solved a problem arising from competitive bidding that has confronted company officials all week. The company stated it would make new arrangements for bidding on the 120,000 shares of preferred, the interest rate on which has, meanwhile, been increased to 5' per cent with the permission of the state Public Service Commission.
