The suit, filed Tuesday in state Supreme Court, also names CBS as a defendant. Arista's suit seeks to enjoin CBS and Miss Knight "from engaging in recording, production, manufacture or com-merical exploitation of phonograph records or tapes" of her performances. It charges that CBS "unlawfully interfered with, counseled, aided and top show.

"One Day at a Time," CBS' hit comedy starring Bonnie Franklin, was No. 1 in the A.C. Nielsen ratings for the third time in four weeks and the fifth time this summer. ABC's "Three's Company" finished second, followed by two more CBS shows "Alice" and "M-A-S-H." "One Day at a Time" had a rating of 22.4, which Nielsen says means of all the homes in the country with TV, 22.4 percent saw at least part of the show.

Of the week's 20 most-watched shows, 18 were reruns. The exceptions were an ABC movie Sunday night, "Newman's Law," tied for 12th, and "Switch" on CBS, tied for No. 17.
