I heard Charley say outside the door "stand back or I wtl shoet." Sims sworn'and deposed: was in the old kitchen at the back and heard Charley say" stand back Jonas or 1 will shoot." Almost instantly then tb cap snapped and right after that th shot was fired.

I first heard a cap snap and then saw the shooting. I did no hear 'Jonas say anything to Charley nor did he have any weapons in his lands. Cross-examined. two men were to the west of where I stood about 80 feel, Charley once warned Jonas to stand back but Jonas continued to advance. States Attorney McNulty rested the case tor the people at this stage, Mr.

Hope then called the accused, Chas. Carr, being sworn said: 1 am the party who shot Jonas Johnson On the day of the shooting. Jonas abused us all and I went to the summer kitchen for my gun to defend myself Jonas kept coming towards me and 1 told him to stand back. I snapped a cap and theft fired tho gun. I was in fear of bodily harm. did threaten to strike my mother. When I interfered he called me a I knew where the gun was because it was always kept in the kitchen.

Jonas was two steps from the kitchen when snapped tbe first cap and 25 'eet when I snapped the seconc and shot him. Jonas boat me abou two years ago and a year ago he choked me to make me -mind him- I was not laid up from tbe choking. Prior the shooting Jouas threatend sink mother, my sister and myself in the soa Jona.8 was of bad disposition, drunk or sober. I was four feet from Jouas when I shot him. Ho made a grab for tbe gun.

Johnny Carr, I was at the house when Charley oamo home on tbe mule. I put up the mule am oame to tho bouse and saw Cbarluy come out of tbe kitchen door and Jonas after him. Charley ran and got tho gun Jonas went after him, Charley snapped a cap at him. Then Charley said "stand back or I 'will shoot you." Ho then fired and shot Jonas.
